11382. No vote cast in the recall election shall be counted for any candidate unless the voter also voted for or against the recall of the officer sought to be recalled.

cbolt just mentioned that that part of the law was overturned. I am pouring through the code right now, and I can't find anything definitive on this one.

That was the one thrown out by a federal District Judge in San Diego awhile back.

Assuming that's the case, then the "Yes" and "No" advocates have the same risk of overlooking Q1, and neither side of that issue has an inherent advantage or disadvantage based on such oversight.

Hmm... I think I disagree with your statement that neither side has an inherent advantage. The Grayout fans are there for one reason: to vote NO on #1. They will vote Busta or some other freak as an afterthought, but they are going to search for and find the #1 question.

On the other hand, those debating here whether to vote for Arnie or Tom are most interested in that line, not the #1 question.

As I see it, there is a definite advantage to the true blue demodogs, and a real risk for this to be an important factor.

Incidentally, I actually called my husband, who is voting on his way home from work, and cautioned him about being careful to vote the "Yes on Recall" box, before I ever posted here. Also suggested he pass the word at the office...

I hate worrying about this, I'm starting to feel like Florida in reverse, the last thing I want to be thinking about right now (!).

By my reading of this, those who today said they forgot to vote on question 1 have lost their candidate choice as well.

Then all those voters will have been disenfranchised. That is, if Arnold wins.

Orange County is using optical scanner for this election. March we will be using something called an e-slate machine. I saw one in July and IMO they s**k.

We have used eSlates in Harris County (Houston), Texas for a year now, and, while I was initially skeptical, I now have high confidence in them for many reasons that I won't elaborate on in this thread. The essential thing is to have friendly poll workers help explain the system to voters, particularly computer-shy voters, the first few times. I think it might be very important for all republicans and independents to make phone calls to their CA friends suggesting the same thing. This really could make a difference.

On 30 July 2003, the United States District Court for the Southern District of California
held that Elections Code section 11382, which prohibits a voter who has not voted on the
first question from voting for a successor candidate, violated the First and Fourteenth
Amendments of the United States Constitution. (Partnoy v. Shelley, Case No. 03CV1460 BTM
(JFS), RJN, Exh. S.). Secretary of State Shelley does not intend to appeal the court's
decision.

Hey, maybe the tide is beginning to turn on the left coast, since the people are becoming more and more politically aware of the tax and spend liberal platform-oh, and the grope attack, IMHO, gave a loud notice as to their last minute smear tecniques.
