Doesn't work that way for public figures, or defendants in high profile cases. They can deny everything, in person or through their attorney. If your worried about saying too much, you just issue a one line denial and take no questions until the trial or indictment.

But, Rush also has a radio show, and dragging his feet might keep him in the limelight. A denial would be enough for some new listeners to tune out. You can't say, "my publicist advised me not to comment". He's setting things up for a big, public, explanation, where he will probably deny everything illegal, mention that he took painkillers after surgery, maybe that it got out of hand for a little while, and then go on to talk about how the media targeted him because he's conservative. Then he rallies his supporters. Rush is still an entertainer. The only thing worse than lawyers is the media.

That sounds close. It certainly doesn't sound like he's planning on a trial but possibly a suit against the maid and/or Enquirer.

How does the saying go, "There's no such thing as bad publicity."

Can't even imagine how his audience has surged, at least today, to hear what he had to say about the allegations.

I think that's exactly where this is going. I think the truth isn't as shocking as the media wants to make it out to be but it is, in some ways, damaging nonetheless. The one thing that has always ticked off the left about Rush is that he has given them so little to puncture his reputation with. The worst they could do was call him a divorcee and a draft dodger (he's been divorced twice but was never drafted - the dodger stuff is what the left always implies about conservatives who never actually got into combat - see George W., Quayle, etc.).

So if Rush had any sort of addiction issues or went outside the normal doctor-patient relationship to acquire prescription drugs, the left is going to pounce on it for all its worth and distort it far beyond the actual truth.

But I knew he would not comment specifically on this because there is an ongoing criminal investigation and certainly Roy Black is not going to advise a client to say anything admitting culpability, particularly before being asked in a court of law. I knew it would be a quasi "no comment" at this point.
