mwll, I know that...I teach US constitution (am administera US Gov't test as I write), I was referring to jurisidiction as far as the fact that this is a STATE election. I think they are using VRA (Voting Rights Act) and FEC rules to jawbone a reason to get involved. Agree with Billybob that SCOTUS is likely to slap them down. again.

Thanks for clarification. Part of the dirty deed here is that Davis is hoping that, even if the USSC reverses this asinine decision, he can play the "you are being disenfranchised" card with minority voters to increase their turnout to vote NO on the recall.
The RATS nationwide are also hoping to continue to stir the pot with minority voters in 2004... first Florida, now California... all brought to you by a conservative Supreme Court and George Bush... accusing the GOP of trying to fix elections, which is the exact opposite of the truth.
The reality is that the USSC should not get routinely involved in these election decisions -- it is dangerous for the Republic. And it sickens me that the RATS want to go down this pathway, which is terribly troubling for the future of the country -- they care more about near-term, raw political power than the health of a representative democracy.
