Just great. The 9'th Circle Jerk of Shlemeels does it again... If I were a "minority" I think I'd be offended as hell that some goateed left wing kook got a court to agree I was too stupid to work a punch card machine. Guess touch screens and computers are more illegal alien friendly then punch cards eh?

You may recall that I was predicting that the 9th circuit court would take the case and throw a monkey wrench in the works.

You will notice what the 9th circuit court has done. It has declared the recall election unconstitutional as planned based on the Supreme court Decision made in the Bush-Gore case in 2000.

Note also that the 9th has not imposed a remedy. Thus the supreme court must over rule its basis for ruling for Bush in 2000 in order to rule against the 9th in this case. If the 9th had imposed a remedy the Supremes could overturn the remedy with out overturing the other issues.

This ploy puts the supremes in a strange place. They know that if they overrule the 9th they will be charged with rulling one way for Bush and the opposite way for Davis on the very same issue. The national media would have a fun time with that.

It will be interesting to see what happens. Perhaps the supremes will not take the case, but rule it will get in the game if the remedy does not suit them.

I think it is working out much like I predicted 2 months ago. That the 9th would fix it so Davis keeps his job.

Everybody and his lawyer told me there was no way and no issue that could be used to get the 9th in the game. Lots of people told me I was a fool when I said the recall would not work.... I may still look foolish, but not quite as foolish as I did two months ago.

It is exactly like what I always say. The law is whatever the judges say it is..

Ut, oh, every time I go into a 7-11 I see those same minorities punching LOTTO tickets left and right. States better put a hold on those LOTTO games until they clear things up!

Perhaps Nino will, but as Billybob pointed out, he steps in (assuming HE is reachable, of course) if and ONLY if Sandy is unavailable. And that just doesn't happen -- unavailability, I mean -- in this era. She could be found but ill, or somehow be mountain climbing in the back of a yak, but otherwise, I don't see Nino getting the call.

Time for some more analysis (including some items not explored just yet):

The successful recall of Davis in October was all-but-assured. Indeed, Bustamonte's "no/but vote for me anyway" strategy was in deep trouble, even with the fraud (punch-card) machines ready to manufacture votes at full-tilt. Both Arnold and Tom were making headway on the alleged front-runner. The Dems were unsuccessful in stopping this impending disaster in every venue short of the 9th Circus. They even were set to lose on Prop 54 (the ruling also mentioned Prop 53, but I have no idea of what that is about).

Knowing that their fraud machines were about to be legislated out of existence (they'll be illegal in March just in time for the Presidential primary), they decided to use them one last time in an unconventional method before the one court they could count on; have the ACLU sue in federal court claiming "unequal treatment" of votes from these fraud machines, knowing the case would eventually get to the 9th Circus. The clowns didn't disappoint them, giving them everything they could ever hope for (no recall election or election on Prop 54 this year).

This, if not overturned, puts the recall election and campaign right into heart of an election where DemonRATs and only DemonRATs have a stake in things (there's no Pubbie Presidential primary, you've got the 9-or-so Mental Midgets on the 'RAT side, and there's no state primaries that I know of). Combined with the expected 2 or so months of renewed motor-voter fraud (the illegals can start getting drivers' licenses on January 1), there's no way that the recall or Prop 54 "Yes" gets more than 40% (which would make Bustamonte's plurality of 47% in the second half of the recall election null and void).

But then, it seems some of their own people think they are too stupid to do so. Why would I be surprised if a bunch of white guys agrees?

If minorities can't operate a punchcard voting machine, then why are the Democrats arguing that giving the illegal ones California Drivers Licenses is going to make the roads safer? You'd think that a punchcard voting machine is easier to operate than an automobile...

Thanks for reminding me to "thank" him for the bushwhack job the reporters did on us in Wisconsin that night (I managed to sense something was up with the herd and stayed just far enough away from the microphones to avoid getting caught in that snare).

Paez was one of the judges on the panel that issued this opinion. I suspect that he regards himself as, in the words of the opinion, "of color."
