Since this was only 3 out of 35 judges, can't they go for a complete 9th circuit vote and bypass the SCOTUS.
We have been set-up by the best. I agree it is now being rewritten for an election issue. Unbelievable! I wouldn't fall for the trap. The opinion was written to be appealed. I'd rather have California have to keep Grey Davis then open up that can of worms again.
Don't go to the SCOTUS. It's a trap.

If one Republican drops out now, those votes are trashed. They won't count, right? Military gets shafted again!

to allow a Democratic candidate for a federal seat to "win". and the SCOTUS should have let that go forward? Well, since a candidate for President does not "win" until the Congress counts the electoral votes, and since the Florida Legislature was and is the sole provider of electors, I presume that said Republican legislature would have submitted a slate of electors to the Republican House of Representatives which would have satisfied your expectations without violating the Constitution.
The fact that the Florida Supreme Court was planning to create a second, non-Constitutional slate of pseudo-electors is not the business of the Supreme Court-it is the business of the People and their Congress.

Thanks, sir. I always enjoy your analyses of these issues. I don't practice constitutional law, but was very interested in it in law school (UCLA '81) and did a couple of seminars in the field. I was always troubled by the federalism implications of the one-man, one-vote cases and, absent the sort of de jure discrimination that traditionally triggered equal protection intervention , thought the were wrongly decided. The impact of those decisions on California were incalcuable, essentially giving almost complete control to the populous South and resulting in the massive water and energy transfers of the '60s and '70s.

Isn't that a racist reason by the 9th? Basically, they're saying that minorites are too stupid to figure out the old machines.
I happen to believe otherwise, that minorities are more than capable of figuring it out -- to say anything but that is ridiculous and offensive. Of course, that is a conservative viewpoint. And yet, we're the ones with the dangerous agenda!

The Nine Circus have not only said voters are too stupid to cast a ballot, elections must be 100% flawless - they've given themselves a license to run California's internal affairs, something our federal system forbids. I mean their whole reasoning to nullify an election a load of pure BS and they knew they were looking to get overturned, or else they wouldn't have given themselves a one week escape hatch. It seems the Nine Circus Clowns are incapable of following the law or common sense. The only thing that will deter them is fear of embarrassment although I recall in a death penalty case a decade ago they tried to overrule the SCOTUS three times before the nation's highest court had to issue an unprecedented order prohibiting them from making any more rulings in that case. So you have to wonder if these folks on that appellate court learned anything from that fiasco.

I'm originally from St. Louis, in a nice suburban neighboorhood, and we've always used punchcards.
It wasn't that hard to figure out at 18 WHEN I VOTED FOR THE FIRST TIME!!! It got easier as I voted -- imagine that!

Some have suggested that the ruling implies that minority voters are less competent than others.
There is another explanation for concern that minority representation can be affected, even assuming that individual voters are equally competent.
Consider the following scenario:
The mythical state of Aztlan consists of two counties:
County of Kalifornistan consists of 1 million voters who are 95% socialist due to a large minority population.
Freeper County consists of 1 million voters who are 95% non-socialist.
Proposition Z is on the ballot (allowing drivers licenses for domesticated pets ) and is supported by 95.5% of Kalifornistan County and 5% of Freeper County.
A perfectly accurate vote count will result in the following:
------------- Kalifornistan Freeper Total
For Z 955,000 50,000 1,005,000
Against Z 45,000 950,000 995,000
This would result in Prop Z becoming the law of Aztlan.
Consider now that Kalifornistan County uses a flawed system which causes votes, regardless of the voters intention, to be discarded 1.1% of the time.
The new election results would be as follows:
------------- Kalifornistan Freeper Total
For Z 944,495 50,000 994,495
Against Z 44,505 950,000 994,505
In this second case, there is no necessity that there be any voter incompetence. The mere fact that ballots get randomly discarded in the "minority" county regardless of voter preference results in a changed election outcome.
These kinds of results are dictated by the mathematics of the situation and only gain relevance because of how close some recent elections have become.
The analysis above in no way justifies the postponement of an election. Every county in Aztlan ( or in Kalifornia ) has an obligation to ready itself for binding elections on constitutionally dictated schedules.
If the federal government wishes to meddle in the election process, they can buy all the election equipment they want, or dictate to the state that such equipment shall be bought. The only thing they should not do is reward the incompetency of our incumbents with additional incumbency. This way lies tyranny.

that FL supreme court could have issued ruling after ruling stopping certification of results they did not like, or stopping the legislature. sure, what you describe looks good on paper as the law is written. but since when do these liberal courts care about that? florida would have been a nightmare if the SCOTUS had not acted.
