Legislative vetos are UNCONSTITUTIONAL and have been ruled accordingly (see INS v. Chadha). If the senate does this we should be able to strike it down in the courts.

Ah yes...early '80's right? SCOTUS struck legislative veto down as unconstitutional.

Actually, if executive departments are going to have any ability to make rules that have the force of law, 50.0% of either body of Congress should suffice to prevent such rules from taking effect. Otherwise, the net effect is the creation of laws which do not have the approval of Congress.
