N.C. man charged in 11-year-old's rape had W.Va record

SHELBY, N.C. - A Cleveland County man charged with raping an 11-year-old girl and an 18-year-old woman was twice released from prison in West Virginia for good behavior.

Since his release, Danny Ray Johnson has been accused of violating his parole terms and committing serious new crimes.

Johnson, 43, of Lawndale was jailed in 1982 for grand larceny after stealing about $700 from a handbag. His sentence was to run until 1990, but he was paroled in 1985 for good behavior, West Virginia Parole Board chairman Doug Stump said.

Less than a year later, Johnson was convicted of first-degree sex abuse, robbery with a deadly weapon and assault while committing a felony after he attacked a woman with a knife and stole $15 from her.

He was sentenced to 37 years in jail, which meant he would be released in 2023. The West Virginia parole board denied his release four times beginning in 1999, but agreed to his parole request in December 2002.

"The parole board felt that he could survive under a restricted environment, but only if he continued to take his medication and it was monitored," Stump said. Johnson had a mental condition, Stump said.

Johnson was not released until April 2003 because the parole board did not approve of his plan to join the circus upon his release.

Stump said Johnson later told the parole board he planned to move to North Carolina to live with his mother, which both West Virginia and North Carolina officials approved. Johnson was released on parole in April and moved to Cleveland County.

This week, some five months after his release, Johnson was charged with one count of first-degree rape, four counts of first-degree sexual offense and two counts of robbery with a dangerous weapon in connection with an attack on an 18-year-old Catawba County woman.

Also this week, Johnson was charged with two counts of first-degree statutory rape, one count of attempted first-degree murder, one count of first-degree kidnapping and four counts of statutory sex offense against the 11-year-old girl.

The girl lost her mother at a weekend tractor pull event and was discovered at 5 a.m. Sunday in a wooded area less than a mile from the site. She was left naked and tied to a tree with a cut on her chest.

"Obviously, I regret giving him parole," Stump said.

Stump said Johnson was granted parole in West Virginia after he exhibited good behavior, including taking his medication and attending classes on such topics as anger management and victim empathy. As a condition of his parole, Johnson was required to continue the classes, take his medication and live in a residence free of firearms, alcohol and anyone under the age of 18.

He added that Johnson received psychological evaluations about every two years while incarcerated, and they showed his mental condition had improved on the medication.

Tracy Royster, judicial district manager for Cleveland and Lincoln counties, said Johnson complied with his parole supervision after he moved to North Carolina, but West Virginia officials issued a parole warrant on a technical violation.

It's unclear when and how Johnson violated parole while in North Carolina. Royster referred questions to West Virginia officials, who did not return several messages.

If Johnson is convicted for the rapes in North Carolina, he would serve his sentence here and then be returned to West Virginia to serve the more than 20 years left on his sentence there, Stump said.

Since we cannot rely on our justice system to keep the trash locked away, what are our alternatives?

Only one thing...ALL convicted sex offenders should receive a sentence of life in prison with no possiblility of parole...or death. The choice should be left up to the victim and their family.

No, I agree with you. These people need to either stay in jail or be put down like an animal.

However the courts will treat you or I like the one who needs to rot in jail.
