MSNBC: Court of Appeals Seems to be Leaning in Favor of ACLU Suit to Postpone California Recall

A three-judge panel of the ultra-liberal 9th Circuit Court of Appeals today heard arguments in the case the ACLU has brought to postpone the CA recall election till March.
The ACLU is arguing that the punch card system still in effect in some counties will disproportionately disenfranchise minority voters.
In a live report on the hearings, MSNBC's David Shuster (formerly of Fox News, and a seemingly sound reporter) said that "things could not have gone worse in the hearing for the State of California (which is arguing against the postponement)."
Shuster said that two out of three of the judges made comments very favorable to the ACLU, along the lines that there was a serious problem, that the problem couldn't be remedied through voter education, etc.
The state specifically requested a quick ruling, to give them time to appeal to the US Supreme Court. This apparently reflected their very real concern that the Court of Appeals will rule in favor of the ACLU and grant the postponement.

9th Circuit = Fla Supreme Court
If the 9th rules against the recall, look for SCOTUS to clean up the mess and the libs to once again say that SCOTUS stole an election. This isn't about the election, it's about having another point of attack against the GOP.

The Ninth Circuit is a renegade court that blatantly permits its liberal politics to influence its decisions. Its rulings are overturned by the Supreme Court far more than those of any other circuit court.
I think we have to be prepared for the fact that the 9th Circuit is going to grant the ACLU's request for a postponement of the recall. Then it will be up to the Supreme Court.
Can't you already hear the liberals screaming: "it's Florida 2000 all over again!"
One big difference: in Florida, the US Sup. Court overrode a state court. Here, they would be overruling a maverick, out-of-control federal circuit court.

I hope this happens - the recall has become a charade. Voters will be po'd at the judiciary and will protest with their vote next election. Davis will be thrown out, and we have time to do better than Ah-nold.

The Nineth Circuit is the liberals' trump card; apparently, the court looked at recent polls showing Davis losing by a wide margin and decided to save him.
Let's see if the US Supreme Court comes back from recess to hear this case.

If these judges agree with the proposition that the problem with the vote cannot be remedied by voter education,,well,,are they saying their minority voters are not educable therefore retarded. Seems to me the minorities ought to be offended that they are seen as dumb as posts.

At least in Florida they acted after an election.
This is bogus. Didn't Cali have elections in 2002 (and thereby after the 2000 mess)? Where was the ACLU then? Sounds like Davis has them in their pocket.

It's not clear when the court will render its decision, but as noted the state of CA requested the judges to rule ASAP to give the state the time to appeal to the Supreme Court.
Then again, given its blatant liberal bias, perhaps the 9th Circuit will intentionally delay its decision to virtually the last moment, making it impossible to get before the SCOTUS in time to hold the election on a timely basis.
