FREMONT -- A 41-year-old Fremont man whose dog was shot by police officers when they forcibly entered his house looking for marijuana plants has a prescription from his doctor to use pot and a certificate from the Oakland Cannabis Cooperative allowing him to grow and possess it, according to documents obtained by ANG Newspapers. Robert Filgo and his wife, Yvette Filgo, 38, were arrested Tuesday night after seven police officers served a search warrant at their Niles home and found 79 plants in the back yard and garage.

I don't blame the police completely either; it's the system that allows for these unfortunate incidents to occur almost on a daily basis.
The present system says that given the choice of allowing a druggie to flush his pot down the toilet or startling an innocent citizen with a dynamic entry, the choice should be the latter.
I'm willing to allow the druggies to flush their dope if that means to put an end to dynamic entries under the excuse of a drug bust.
If a big-time drug dealer tries to flush dope down the toilet, the evidence will be too overwhelming to disapper from his toilet bowl and sewage pipes.
If cops suspects that a drug dealer has tried to tamper with evidence using the toilet, then his toitet bowl should be removed and the sewage pipes examined for evidence.
I seriously doubt that major drug evidence can be flushed down the toilet, and that seems a common excuse for these dynamic entries.
Before the War on Drugs, people tried to destroy evidence all the time; for example, throwing a an incriminating document into a fireplace while the cops were knocking at the door; nevertheless, dynamic entries were not that common. . . a man's house was his castle.
The homeowner's name was "Filgo". Sounds like a name for a "filling station". ;-)
I'm not totally familiar with residential sewering, but I'd think it'd be possible to shut down the utilities to the location immediately before the raid. Heck, druggies and stoners aren't likely to notice the water being off, or if they do, they might realize that they occasionally have to spend money on the water bill instead of on dope...

In order to legally serve a warrant without knocking, the "dynamic entry", the police have to have a special addendum on the warrant. One would think that the judges ought to take a closer look at those requests. Yes, usually the justification is to prevent the destruction of evidence; also officer safety - a concept loathed by the druggies and stoners - is cited as justification. If the police burst in throwing flash-bang grenades, it's more difficult for the druggies and stoners to attempt to ready their weapons to murder said police officers.

You're unto something there.
Cops can find the main shut-off valve outside the house, shut off the water, and watch the druggies going berserk wondering why the toilet tank is dry. . . LOL!
On a more serious vein, yes, it is time to revise our current procedures and excuses for dynamic entries. In this case, a small-time pothead with a medical condition should have been served a regular warrant, IMHO.
In line with that thought, get rid of all the STUPID laws on the books.
IF the JUSTICE system worked properly, and the COURTS/JUDGES allowed the punishment to fit the crime, then we would find less need for all the silly laws.
Most laws are not made with the idea of STOPPING anything. They are made for many reasons, among which are to ensure employment of lawyers, judges and to give the wealthy and powerful ways to get around the law.
GET IT YET? LAWS are made to enable some to be ABOVE THE LAW.
Caused by hyperinflation of drug prices due to them being available only on the black market. Remove the excessive taxes on a pack of cigarettes and how much do they cost...? $1/pack?

You have made it obvious that wear blinders and refuse to look left or right. You have this severe focus and no amount of fact or reality can influence you.
Mainly what I am saying is that your focus on Stoners and druggies as the cause of ruthless murder of innocents is very, very, naive and immature. Some day you may wake up and realize that there are many activities you are involved in that promote the murder of ruthless innocents. You pay taxes to a government that funds the CIA, which kills innocent men, women, and children, because they are in the way or know something.
When SWAT Teams break into the WRONG house, and SHOOT and KILL the Wrong person, by your own words, YOU ARE THE INDIRECT MURDERER OF INNOCENT MEN, WOMEN, and CHILDREN.
