California Republican gubernatorial candidate Tom McClintock, who trails only Arnold Schwarzenegger and Lt. Gov. Cruz Bustamante in opinion polls, is barred from publishing a position statement in the voter's guide for the Oct. 7 recall election because he did not fill out the required form according to guidelines.

The article also says there is no provision in the law allowing for amended filings, and that when he went to court challenging that, he failed to provide the court with documentation that he had made an amended, timely filing. OK, maybe he did file on time? But, why would go to court totally unprepared? Hmmm... I got it, "Let's go to court, but not bring any evidence. We hate to confuse the court with facts."
I am still concern about his disillusion of grandeur in checking that box.

The 3rd District Court of Appeals ruled Thursday McClintock had the right to amend his form, but it did not see evidence the document was turned in on time. Due to a mixup, the court did not receive a faxed copy of McClintock's form, which shows he submitted it to the secretary of state's office before the deadline. You file a lawsuit, it's up to you to bring your evidence to court. Nobody else -- least of all the judge -- is going to do it for you.

I am still concern about his disillusion of grandeur in checking that box. That doesn't bother me; I could see doing that as a matter of principle -- if there were no other consequences. But that law has been in place for three years. How can he claim not to have known about it?

This is the problem with opinions and I am afraid our US Supreme Court has gone to rendering them the same way.
If nothing is there to forbid it they choose what they wish depending on the moment in time.
This old boy is probably the most capable of the bunch to be Governor for Cailfornia but it looks like he is getting the screws from both parties.
It may be a blessing in disguise for him and a thorn for the California voters I dont know but this is called the "Rule by Law". ha.

Generally that's not the way the law works. If corrections/refilings prior to the deadline arent allowed that has to be stated in the law. He refiled the corrected form before the deadline. He met the stated requirements of the law, as there are no previsions to the contrary. There is nothing supporting the States position that corrections prior to the deadline are not allowed. Zip.

McClintock knew the rules. Heck, he's running specifically as the experienced, polished pol who can get things done. Now he has a bit of egg on his face. Best he let the matter drop before the mess gets any bigger.I agree. California needs a "the buck stops here" governor who takes responsibility for his own actions. Not another whiner who points fingers and cries unfiar.

Statements like yours contribute nothing positive, and much harm, to this disagreement among friends. The worst people in our nation must just love the circular firing squad to which you've just contributed your bullet.

We may disagree on who can win/should win California but that comment is a bit DemocRAT like.

Even if you are correct (which I will concede only for the sake of argument), the article clearly states that McClintock failed to place evidence before the judge showing that he had made a timely refiling.
I repeat: Ever since Florida, we've been the ones insisting that elections be run by the letter of the rules. When there weren't enough precinct workers in St. Louis and the Dems wanted the polling hours extended, we hollored fraud -- and were right to do so. So it sounds more than a little odd to hear a Republican crying about "technicalities". It is also extremely bizarre for a candidate who is running as an experienced professional screw up this way.

That is precisely why we can never affort to have Democrats elected to anything. Vote for the candidate with the greatest possibility of defeating the strongest Democrat.
Someday that may allow voting for third party kooks, but today it means voting for strong Republicans, RINO's or whatever. In the current California race, voting for anyone other than Arnold means helping elect a Democrat.
