the only problem is Judge Moore had to present it to Judicial activist Carter-appointed ALCU favoring Judges...

Two of the three appellate judges that ruled against Moore were Republican appointees. Much as I hate to spoil a good story with some inconvenient facts ;)

They followed the ruling of the SC, even though the SC had no Constitional right to get involved. "Congress shall make no laws..."
Guess they just weren't thinking. All that PC repitition.
