A US military investigation has concluded that the crew of a US tank acted properly when it fired on a Baghdad hotel filled with foreign journalists April 8, killing two television cameramen, US officials said.
The investigation found that the tank fired at the Palestine Hotel because of reports a spotter was coordinating Iraqi fire from there, an official said.
A Ukrainian cameraman for Reuters television, 35-year-old Taras Protsyuk, and a Spaniard working for the Spanish television network Telecinco, 37-year-old Jose Couso, were killed by the shell blast.
Three other Reuters television journalists were wounded in the incident, which came amid heavy fighting in downtown Baghdad.
The Central Command's report on its investigation was not immediately made public, but a summary of its findings was sent to the governments of Spain and Ukraine, said the official.
"The report appears to confirm exactly what was initially reported in April," said the official. "The rules of engagement were not violated."
US forces picked up transmissions on a captured Iraqi radio of someone in the area directing Iraqi fire, a second official said.
The tank targeted the Palestine Hotel after seeing someone with binoculars on an upper floor acting "in a manner consistent with that of a spotter," the official said.
Images captured by the French television network France 3 showed the turret of an Abrams tank on the west side of the Tigris river turn toward the Palestine Hotel 300 meters (yards) away on the opposite bank, take careful aim and fire.
In the immediate aftermath of the attack, US military officials said the tank was returning hostile fire from the hotel. But journalists at the hotel disputed that account.
In Kiev, the Ukrainian foreign ministry said it had been informed of the investigation's findings.
"According to the American side, ... the shot was fired in self-defense and in complete conformity with the rules of combat," said ministry spokesman Markian Loubkivski, citing the US report.
"The American tank acted in response to information concerning the presence at the hotel of a spotter who was coordinating the Iraqi fire."
A separate investigation by the Committee to Protect Journalists, a watchdog group, concluded in May that the attack, "while not deliberate, was avoidable."
Pentagon officials and military commanders on the ground in Baghdad knew the hotel was full of journalists, but failed to warn the tank's commander, the committee said.
That cameraman should have been thinking: `Why is that gun aimed at me? Maybe I should quickly put the camera down sideways so the gunner can see it is a camera and not a missile launcher, and maybe I should also wave both my open hands back and forth so as to send the message that I am not a danger to him. Or, maybe I should get the hell out of here.
"I'm just sending [via satellite] great info to the [remains of the] Iraqi Army showing exactly where you are at...."
The other great line is "a female media type... suggested ...granted `Ancient Religious Status' because many member
of the media were staying there."
This media type has neglected to read historical criticisms of journalists in war by such successful military leaders as
William Techumseh Sherman.
