That is an interesting statement indeed. I think what Mr. Paul meant was, if you don't like it, take it to the Texas State Legislature and not the Supreme Court.

He said that it was a decision for locals to make about how they wished to regulate behaviors that could impact on others.

Do you think the state has the mandate to debate behaviors that could impact on others? If so, then they have the mandate to regulate them.

That is between you and your state.

The feds have no jurisdiction:

Section. 1. All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

If you can find a "right to privacy" in this then you can also find a right to a state funded abortion, you could also find seperation of church and state in the first, and you'll find that "the right of people to keep and bare arms" only applies to the National Guard.

Well you have a right to be free from warrantless *unreasonable* search and seizure but nowhere do I see a explicitly enumerated "right to privacy" that many claim to be Constitutional. I wish there were such a thing as I am a privacy freak.

To which amendment are your referring?

Do you have the right to smoke crack in your own home? Do you have the right to distill your own alcohol? Do you have the right to set up a meth lab for your own personal use in your own home? Do you have the right to run a house of prostitution out of your home? Do you have the right to have sex with children in your bedroom?

There are lots of things you do in your bedroom that an individual state can make illegal.
