Executive orders only affect the Executive Branch.

I admit I am no expert on it.  But in the case at hand,
is it not the executive branch that is under discussion,
ie, the defense department.?

True --- but the EO is not a law.

All president Bush has to do is prepare a new EO revising or revoking an EO by a previous President. (This is easily seen by scanning the EOs of various Presidents).
