The thought ocurrs to me that perhaps there is a vague low-level conspiracy here by judges and litigants to allow these cases to keep going until a certain point at which they are tossed out. That way the rule of law is preserved and judges are shielded from the scorn of congress and the public for making outrageous rulings, but the gun makers are forced to spend mass amounts of money to defend themselves. They're trying to bankrupt them one court case at a time.
