NAACP SUIT GUNNED DOWN

July 22, 2003 -- Handgun makers dodged a bullet yesterday when a federal judge tossed the NAACP's lawsuit against the industry after the group failed to prove that blacks suffer unique harm from gun violence.

But Judge Jack Weinstein blasted the gun industry for doing too little to keep weapons away from criminals.

"The industry as a whole has not adopted a responsible approach to limiting sales and supervising its retail outlets," Weinstein wrote in a 175-page decision filed in Brooklyn federal court yesterday.

So should GM limit sales and supervise to whom its retail outlets are selling cars?

Translation: Weinstein REALLY, REALLY wanted to give this to NAACP, but it would have required a degree of judicial activism he didn't think he could get away with.

Is this the same judge that sued the school because his poor daughter wasn't given the title of valedictorian.

The thought ocurrs to me that perhaps there is a vague low-level conspiracy here by judges and litigants to allow these cases to keep going until a certain point at which they are tossed out. That way the rule of law is preserved and judges are shielded from the scorn of congress and the public for making outrageous rulings, but the gun makers are forced to spend mass amounts of money to defend themselves. They're trying to bankrupt them one court case at a time.
