Moments after police apprehended her, Sarah Foust repeatedly used expletives to refer to a hit-and-run victim and said the young woman was at fault for being on top of Ms. Fousts car as she drove away.
If that [expletive] is stupid enough to climb up on that [expletive] roof, then Im sorry about her luck, Ms. Foust said as she sat handcuffed with her friend, Kortnie Henson, in the back of an Irving police patrol cruiser early on the morning of Jan. 3.
The 30-minute rambling conversation was videotaped without the pairs knowledge and played to the jury in Ms. Fousts murder trial Wednesday.
At one point, Ms. Foust, 19, said to Ms. Henson that she did not intend to hurt Jennifer Sanchez, a 20-year-old waitress who died from head injuries she received after falling from the car. Ms. Sanchez had tried to stop Ms. Foust and her three friends as they fled an Irving restaurant without paying their tab. The two women indicated that they did not realize how gravely Ms. Sanchez had been injured.
I wasnt trying to hurt her shes the last thing, person in my mind I would want to hurt, Ms. Foust said.
But Ms. Henson disagreed and questioned why her friend did not stop after their plan to skip out on the bill went awry.
You just, you should have stopped, dude, you should have [expletive] stopped, Ms. Henson said. If you just [expletive] stopped right there in the [expletive] parking lot You swung that girl off the roof, dude. I saw it.
Ms. Foust faces five to 99 years in prison if convicted of murder.
In the first two days of the trial, defense attorney David Scoggins has stressed that Ms. Foust is guilty of intoxication manslaughter - not murder. He said the videotape from the police car reinforces that argument. Jurors needed a written transcript to follow the rambling conversation and slurred speech of the two women.
The two also used racial slurs and made derogatory remarks about the black officer who had arrested them.
Officers did not perform any sobriety tests on Ms. Foust for several hours. She was charged with driving under the influence and pleaded no contest to that charge the morning of her arrest.
In a formal written statement to police detective Randall Johnson after her arrest, Ms. Foust said that she had just $2 when she and her friends went to a Bennigans in Irving with the intention of not paying. The group consumed $131 in food and alcohol before sneaking out of the restaurant.
Ms. Foust said in her statement that Ms. Sanchez had chased them into the parking lot but had stepped aside when Ms. Foust backed up the Chevrolet Nova. Ms. Foust said she drove off without realizing Ms. Sanchez was on the car.
Detective Johnson testified that he did not believe that Ms. Foust was telling the truth in her statement. In cross-examination by Mr. Scoggins, the detective said her actions went beyond reckless.
Witnesses to the events that night testified that Ms. Foust backed into Ms. Sanchez as she tried to record the cars license plate number. The impact knocked Ms. Sanchez onto the cars trunk. As the car sped away, Ms. Sanchez moved to the cars roof, possibly in an effort to keep from being thrown.
Prosecutors Keith Robinson and Howard Blackmon said they expect to wrap up their portion of the trial Thursday.
Mr. Scoggins said that as part of his case, he plans to have Ms. Foust testify on her own behalf.

Another piece of garbage of this world is behind me honking her horn for me to go. After I'm finally able to turn, she speeds past me on the right and gives me the finger. This woman would rather have me run over a pedestrian than to wait a few seconds. I meet up behind her at the stoplight (she really got way far ahead didn't she) and she's glaring at me in her side view window hoping that I'll do something. My husband said I should have smiled and waved at her. I hope she honks her horn and flips someone off that's had a really bad day and her attitude is the last straw. To bad I won't be around to see it.Yeah, I get so put off by idiots that speed past me, only to get to the red light before me. I see that and when I pull up beside them, I think 'Oh, aren't you SOooo smart ? You got to the redlight before I did, huh?' Accidents waiting for a place to happen, imho. I see that crap all the time. Stupid, offensive, dangerous.
