URGENT ACTION ALERTS!!!

I’m back from vacation, and leaving next week on sabbatical. I had not planned to send any updates this week, but guess what? We have two MAJOR action alerts that need your immediate attention!

(1) I was stunned to discover over the weekend that KFYI not only pulled my radio commentary for last Friday, but for some reason also turned it into a news story that played in drive time Friday afternoon. We were never told the ad was being pulled. The charge made against me – that I equated homosexuals with pedophiles -- is completely false and malicious. For KFYI to air such an allegation without me being able to respond, and to essentially side with the charge by removing the ad, is defamatory. Below is the text of the ad for your review, or you can listen to it in the radio archives at our website, www.azpolicy.org:

“In her rush to provide a political payoff to gay activists by signing an executive order at their fundraising dinner, Gov. Janet Napolitano may have made a crucial legal mistake. Her executive order providing special workplace protection based on ‘sexual orientation’ failed to define that term. Now, in the midst of public outrage and numerous scandals about child sexual abuse, there is a real possibility this order could provide special job protection to those with an orientation toward pedophilia! Imagine this case, for example – a state employee who works with children is discovered to have a conviction in another state for child sexual abuse. When the state moves to fire him, the employee argues in court that his ‘orientation’ toward sex with children, combined with the governor’s executive order, protects him from termination. Could this year’s scandal be the Pedophile Protection Act of 2003?”

Clearly, nowhere in this commentary do I make the claim that homosexuals are pedophiles. In fact, pedophiles seeking protection under the undefined term “sexual orientation” could be either straight or gay. Men who molest little girls are pedophiles. The fact that “sexual orientation” could be defined to protect pedophiles has nothing to do with homosexuality. It has to do with child sexual abuse, whether straight or gay.

I hope you will take a moment to immediately contact the persons listed below and urge them to: (1) admit the charges against the ad were false; (2) apologize for the false news story, and (2) re-air last week’s commentary. If you are a regular KFYI listener, it helps to let them know that.

Our free speech rights are truly in jeopardy if this decision stands. This was political speech – which should receive the greatest protection – and it was paid for! For KFYI to buckle under based on a few completely false complaints is an outrage, and makes their claim to promote “hot” and controversial talk radio look rather hollow. Moreover, our ability to get our message out on controversial topics will be severely compromised if this decision stands. Please call or e-mail KFYI today! Call Program Director Laurie Cantillo at (602) 650-5235.

Also, please send e-mail to the President of Clear Channel at:

* Mark Mays, President, Clear Channel, MarkPMays@clearchannel.com

Copies of that e-mail should go to:

* Susan Karis-Madigen at susankaris-madigan@clearchannel.com, and * Laurie Cantillo, at chickboss@clearchannel.com

(2) Following the Supreme Court’s decision proclaiming a constitutional right to sexual privacy that includes homosexual sex, two men have filed a special action in the Arizona Court of Appeals seeking to be married here. You can read our press release at http://www.azpolicy.org/html/pr071403.html. When their offices open on Tuesday morning, please contact the following and urge them to vigorously defend Arizona’s law banning same sex marriage:

* Gov. Janet Napolitano, 602-542-4331, e-mail through website at http://www.governor.state.az.us/post/feedback.htm

* Attorney General Terry Goddard, 602-542-5025, ag.inquiries@ag.state.az.us

* Maricopa County Attorney Rick Romley, (602) 506-3411, e-mail through website at http://www.maricopacountyattorney.org/fullemail.html. (The lawsuit is against Maricopa County, and Mr. Romley is the county’s highest elected legal officer.)
