If Breyer really thinks it should soccumb to international will, Breyer should be impeached post haste.

Incredible.

Yes, to the will, subordinate everything to the will.

Seems I remember someone saying something like that back in 1941 but I can't recall who it was.

Can anyone help me remember?

Naw, this is great! Imagine the things we can do if we can just find some other podunk country that thinks it should be allowed. If European views on gays should be an excuse to override our Constitution, surely we can use the Sudan to bring back slavery (that'll cure the homeless/panhandling/overpopulated prison/unwanted children problem right quick!)

We can use Saudi to bring back forced marriages and honor killings (got a teenaged daughter you can't handle? You'll like this one!).

We can use Singapore to bring back corporal punishment (solve the graffiti problem/ gum-on-the-sidewalk problem/ curb-your-dog issue overnight).

We can use China's policies to kill political prisoners and harvest their organs (no more waiting for kidneys, I got a university professor caught bad-mouthing the prez and he's a type A negative, yay!).

We can use North Korea to bring back torturing those suspected of crimes (solve that Laci Peterson case in 24 hours with a signed confession!)

Oh boy, what a great precedent Breyer's gonna set with this one! Let's all write him and tell him the neat things he can open the door for!

>>If Breyer really thinks it should succumb to international will, Breyer should be impeached post haste.

That was the first word that came to my mind.

I was STUNNED to read that these people who have sworn to "Preserve,Protect, and Defend"The United States Constitution really just see it as an out of date document that has seen better days and is up to their whimsical theories as to intent!!These people should be IMPEACHED!!!Who's going to start a grass roots on this?

If Breyer really thinks it should soccumb to international will,

Breyer and her, and probably Ginsberg and the other liberals. They just didn't say it. Here is O'Connor saying basically that the United States of America should just be in essence one of the states of the EU, take marching orders from them (pigs must have toys, lifers in prison must have hardcore porn).

"Well, you always have the power of entering into treaties with other nations which also become part of the law of the land, but I can't see the day when we won't have a constitution in our nation."

Not to worry - notice that she says "we'll always have "a" constitution. Yeah, but what will it say? Will it be this one, or another one?

Making the constitution subordinate to international will may happen under a liberal US President, sometime in the future. The consequences of such an action are terrifying, civil war or one-world rule. In that case, I would have to choose war.

Breyer and O'Connor share this viewpoint in this article. Moreover, they imply that SIX of them may have this viewpoint.

The subordination of the US to the UN through the Judicial branch is but ONE of the problems articulated. Far more dangerous...EVIL...is in how he blatantly admits that they are *not* interpreting the Constitution, but re-writing it's meaning by parsing it word by word:

When you look at the word 'two' for two representatives from every state in the United States Senate, two means two. But when you look like a word – look at a word like 'interstate commerce,' which they didn't have automobiles in mind, or they didn't have airplanes in mind, or telephones, or the Internet, or you look at a word like 'liberty,' and they didn't have in mind at that time the problems of privacy brought about, for example, by the Internet and computers.

Do you see? Breyer has set himself up as one of nine rulers over the United States of America!

As a side-note...this sort of parsing is *exactly* the reason the War Between the States began.

We need to get these people out of office before they bring about another!

"...Breyer should be impeached post haste."

I heartily agree. By his own words, he violated his oath of office to protect and defend the Constitution against all enemies, FOREIGN and domestic. Those who want to subordinate or eliminate the Constitution are, by definition, enemies of it. There should be no place on our federal courts for such people.

BESIDES, IMPEACHING BREYER AND REMINDING THE COURT FROM WHOM THEY DERIVE THEIR POWERS WOULD BE A HEALTHY DEVELOPMENT. WE SHOULD BEGIN AGITATING FOR HIS IMPEACHMENT IMMEDIATELY AND SERIOUSLY.

Breyer has no more right to apply a holding of the European Court than Scalia has to apply an opinion of a papal court.

>>>U. S. Constitution should be subordinated to international will...<<<

Absolutely wrong. This is worth fighting - in the courts and in the streets.

"....and whether our Constitution and how it fits into the governing documents of other nations, I think will be a challenge for the next generations."

Unknowingly, with this statement, Justice Beyer has started the next war!!

It won’t do any good … Bush would only replace him with another “internationalist.”

I hear Sojourners (a 'religious' nonpartisan social action group) thinks the same thing. Of course, since it really is partisan, Sojourners should have its 501c3 status revoked.

"If Breyer really thinks it should soccumb to international will, Breyer should be impeached post haste."

I am afraid the day is quickly approaching when the people will simply not recognize the pronouncements from the court ( spurred on by things like Kelo, etc. ), and decide the only way to secure their rights by banding together and asserting those rights through force of arms.

But, I suppose some of the Founding Fathers saw a day like that would come. Liberty is worth nothing unless one is prepared to shed blood for it, and that includes fighting enemies both foreign and domestic.
