(CBS/AP) Convicted rapist and cosmetics heir Andrew Luster, who has been on the run since fleeing his trial in January, was captured and being held in Mexico on Wednesday.

Luster, a bounty hunter seeking him and an independent cameraman filming the arrest are in Mexican custody, CBS News has learned.

Ventura County district attorney's Investigator Richard Haas told The Associated Press that the FBI notified him early Wednesday that Luster was in custody.

When asked what would happen next, Haas said Luster apparently has no legal standing to be in Mexico.

Earlier this month, an appellate court denied Luster's attempt to appeal his conviction, saying he forfeited his right to appeal by jumping bail.

Authorities said Luster, 39, took three women to his home between 1996 and 2000 and raped them after giving them the so-called date-rape drug GHB.

He was arrested in July 2000 after a University of California, Santa Barbara, student told police he drugged and assaulted her.

During a search of his home, authorities said they found videotapes of Luster apparently having sex with sleeping or unconscious women. Two women in the tapes testified at trial that they willingly took drinks laced with GHB from Luster but never consented to sex.

"I have never seen a piece of evidence that would equal the power of those videotapes," Deputy District Attorney Maeve Fox said. "They are the most shocking and disturbing things that you will ever see."

The defense argued the sex was consensual, and that the women were pretending to be asleep to help Luster film pornographic movies.

A jury convicted the fugitive heir on charges of raping three women and drugging two of them at his beach house, finding against him on 86 counts. The jury deadlocked on one count of poisoning one of the victims.

Luster fled Jan. 3, during a recess in the trial. The great-grandson of makeup legend Max Factor was sentenced in absentia to 124 years in prison.

In an exclusive interview with CBS News' 48 Hours before he disappeared, Luster painted the videotapes as innocent fun.

"It's one of those fun kind of things you do, you know?" he said. "Break out the video camera, put it on a tripod, let's see what it looks like. Let's videotape ourselves, then watch it. It's fun. A lot of couples do it. It's no big deal."

Luster insisted the women agreed to go along. "Everything that transpired between me and my girlfriends has always been consensual," he said.

In April, Luster's attorney Roger Diamond filed a notice of appeal on behalf of his missing client to seek review of contested rulings that the defense alleges prevented Luster from receiving a fair trial.

Prosecutors argued that state law gives a fugitive no right to challenge a conviction, and the 2nd District Court of Appeals last week agreed.

The California Supreme Court was expected to be asked to review the decision.

Is that why women came forward? To tell what a great time they with you while unconscious?

There should be more recognition of why these guys want women unconscious. They are undoubtedly perverted. Probably have a fascination with necrophilia (sex with dead bodies) caused by jaded sexual appetites. They need to have submissive women in order to get their kicks. Sickos. Guess they can't always get over to the mortuary and do the next best thing....slip 'em a roofie.

Serial predators like Clinton and Luster have jaded-perverted sexual appetites. They can only get their kicks thru force, or sedating women. A doctoral study of serial sexual predators said one of the universal techniques predators use to subdue women is to bite the victim's lip......which Clinton did to Juanita.

Notto downplay his activity, but 124 years makes him eligible after 3/4's of his sentence while a gang banger gets out in 10 to 15 for a murder. duh!!!!

Fox is reporting that Luster, the bounty hunter and cameraman are all in jail until the Mexican authorities sort this all out.

Only if the stinkin' Mexicans extradite him.

Mexico is notorious for giving sanctuary to Mexican citizens who have killed cops in the U.S. and then flee back to Mexico.

Mexico will not extridite anyone who is facing the death penalty or life sentences.

"On April 29, 2002, Deputy Dave March was murdered on the streets of Los Angeles County.  The suspected gunman then fled the Country to Mexico.   It is believed by many that the Mexican Government has refused to extradite the suspected killer because he may be imprisoned for life or  executed for the crime. 

The reason for this website is to bring to light the terrible problem Law Enforcement and United States Citizens face when criminals can flee to Mexico to be considered untouchable.  Mexico's lack of cooperation has led to a suspected murderer running free, laughing at the United States, it's people, and its Law Enforcement. 

Our hope is that this suspect,  Armando Garcia,  is brought to justice and that Mexico changes it's policies regarding harboring murderers of Americans."
