the boy refused to take a breathalyzer testSomebody has been coaching him. But it is a good move, nonetheless. However, in TN you loose your license for one year if you refuse a breathalyzer.

Ayup! Then you get your license suspended for refusing, and still get charged with DWI and, in this case, DWI as a minor.
In CA, that's a big, big deal. You can lose your license for a long, long time, not to mention getting cancelled by your insurance company.

He may still be convicted of DUI but it will be much harder without a breathalyzer result as evidence. I believe that Tennessee has a lesser charge of impared driving that could still (and probably will) get him.

"What is it with these Tennessee politicians whose kids "sh!t too close to the house," if you know what I mean?" I think it has more to do with politicians' kids in general. Their parents are so wrapped up in their own lives that their children often get neglected.

In Texas, refusal to take a breathalyzer gets the license suspension AND a DUI charge.
Maybe the lawyer can get Frist off, but he will likely have the DUI on his record.
Refusing a breathalyzer can be used against you in the courtroom.
