Great post. The FIRE people are 10 years too late! Better late than never. THE PROMOTERS OF THE NEW LEFT REEDUCATION SYSTEM CARE NOT AT ALL THAT THEY ARE VIOLATING SUPREME COURT RULINGS AND STATE AND FEDERAL CONSTITUTIONS AT WILL. It all makes one wonder if 100 lawsuits won by FIRE would turn the tide, or if 100 rulings by the U.S. Supreme Court would matter to these new petty dictators. They will keep on going, because their world view and objectives are based on the destruction of the rule of law.

By the way, the number of court challenges against campus codes filed to date, let alone won, is a mere handful. The ONLY successful campaign to overturn a speech code without turning to a court was the CONSERVATIVE student rebellion against a new speech code at Tufts University in 1989. It involved a number of undergraduate students connected to the University's conservative paper, the Primary Source, and two graduate students (me included). In the campaign (I designed and printed the leaflets), we dropped all the legalisms and went for the ideological throat. The campaign was a late-night effort to rope off the entire campus! with leaflets (also distributed in the dorms). The message on the leaflets: "CONCENTRATION CAMPUS" with "speech forbidden" in Russian, German, and English. It was the message and action that prompted a dramatic and QUICK reversal by the administration.

Every year we wait is another student class deprived of true liberty and freedom. You have two choices -- sue, and wait years, and fall into the trap of the Left (which owns many of the state and federal district courts), or take effective protest actions (as described above, or contacting alumni to boycott administrations, etc.).
