The system does work, and punishment is still achieved when someone is strong enough to enforce the rules. I don't know about the Private's situation, but.....
Just to renew your faith in the system. A troop that I brought up on charges of Disobeying an order and sexual harrassment (multiple charges of which) was just given a BCD today at trial.
Believe me when I say, he deserved worse than he got. Nonetheless, he won't be wearing a uniform anymore.

Thanks for the info Greenpees. I got tagged as Legal Officer in my unit as a collateral duty when I was a JO. We had a couple of guys who REALLY deserved bad paper but the senior Os didn't have the heart to do it and the guys got admin sep'ed. Their defense JAG played the sympathy card and they received honorable discharges w/ negative reenlistment codes!!! During my time in the NAVY (still in) this seems to be the way it works. Conversely, military "justice" can be pretty unfair at times, but sometimes you have to be a harda**.
