If the weapons does prove false, I'd say prosecute him/her the same as if it were a real bomb (they do when someone sends "fake" anthrax or a "fake" bomb in the mail).

Assume that the state not only allows concealed carry, but mandates it of every single adult who is not physically disabled from shooting a firearm (blindness, inability to move arms/hands, et cetera).
