Date set for Sutton confirmation vote (A conservative judicial nominee will be approved)

Senate Sets Vote Date For Federal Judicial Nominee April 11, 2003

The U.S. Senate has scheduled a confirmation vote on April 29th on Columbus attorney Jeffrey Sutton's nomination to the Sixth U.S. Circuit Court of Appeal in Cincinnati.

By agreeing to a scheduled vote, Democrats essentially are giving up their procedural battle to block the former Ohio solicitor's confirmation. Republicans control the Senate 51-49.

Sutton's confirmation has been stalled by partisan politics and opposition from disability-rights groups since President Bush nominated him in May of 2001.

Meanwhile, the 6th Circuit nomination of Ohio Supreme Court Justice Deborah Cook hasn't yet been scheduled for a floor vote. Cook was approved by the Senate Judiciary Committee in February.

At least some of these are moving. This is actually more important than the Owens nomination. We already have a conservative majority on the 5th Circuit. The Sutton confirmation will make us a majority on the 6th.

Some judicial confirmation news: Remember back on January 17, 2003 when the Senate Judiciary Committee held a single confirmation hearing for three federal appellate court nominees? Well, as I reported here last night, Sixth Circuit nominee Jeffrey S. Sutton's nomination has been scheduled for a vote from the full U.S. Senate on April 29, 2003. Today an agreement was reached to hold another Judiciary Committee hearing for D.C. Circuit nominee John G. Roberts, Jr. after the Senate returns from its April recess. Sixth Circuit nominee Deborah L. Cook will not have to undergo another Judiciary Committee hearing, but it's not yet clear whether the full Senate's vote on her nomination will follow the second Roberts committee hearing or will occur sooner.

In other news, The Mobile Register reports here that "President Bush nominates Bill Pryor for federal judgeship; Alabama attorney general hailed by Republicans but could face tough battle for Senate approval." The Birmingham News reports here that "Bush nominates Pryor for federal appeals bench." And The Times Daily reports here that "Bush nominates Pryor for judgeship."

Yesterday's edition of The Dallas Morning News contained an article entitled "Senate debate on Owen nomination may be long. Both parties plotting strategies; will Texas judge be filibustered?" And yesterday United Press International reported here that "The drive to win confirmation for Miguel Estrada, whom the president has nominated for a seat on the U.S. Court of Appeals for the D.C. Circuit, is increasing in its intensity and spreading out across the nation."

I am a Christian that is supposed to "believe it before I see it."
However, in this case, I'll believe it when I see it. I have read too many articles and postings right here stating that the DemonRATS vow to block all of President Bush's nominees with this "super-majority" crap of 60 votes to confirm.

The Dems will in no way will let their their precious liberal courts, that make laws from the bench, laws that cannot make through the Congress, fall into the hands of conservative judges that interpret the law (as written in the constitution) instead of make it.

The drive to win confirmation for Miguel Estrada, whom the president has nominated for a seat on the U.S. Court of Appeals for the D.C. Circuit, is increasing in its intensity and spreading out across the nation. According to the conservative group Americans for Tax Reform, a resolution asking that "United States Senators in the United States Congress work to allow a vote on the floor of the United States Senate on the appointment of Miguel Estrada" has been introduced in 20 different state legislative chambers across the country.

The group says that the North and South Dakota legislatures, along with the state Senates in Georgia, Washington and Nevada have passed similarly worded resolutions calling on their U.S. Senators to end the filibuster of Estrada's nomination as a way of increasing pressure on those blocking the full Senate from voting on the nomination -- including Senate Minority Leader Tom Daschle, D-S.D., and Sens. Tim Johnson of South Dakota, Byron Dorgan and Kent Conrad of North Dakota, Maria Cantwell and Patty Murray of Washington state and Harry Reid of Nevada, all of who have voted four times to keep the filibuster going.

ACtually, there is a unanimous consent agreement that is printed on the Senate's executive calendar. A vote will be held on Sutton on April 29 according to this order. The only way this can be undone is by a majority vote. This will not happen. I understand your skepticism, but a unanimous consent agreement is iron clad.

Yes. However, from what I understand, Roberts is guaranteed a floor vote as part of the agreement to have another hearing. That means conservatives will have a 5-4 majority on the DC Circuit when he is confirmed. I also think that Cook will be getting a floor vote.
