Kerry says justice system becoming too political

DES MOINES, Iowa (AP) Sen. John Kerry said Saturday he is concerned about the politicization of America's judicial system.
The Massachusetts senator, one of nine Democrats vying for his party's presidential nomination, used a speech at a Drake Law School banquet to highlight what he called a disturbing trend in the system.
He said a number of rights are being threatened because of politics mingling with the legal system, including President Bush's push to get conservative judges appointed to the bench.
''I don't believe we need conservative judges or liberal judges or anything but patriotic American judges who will enforce the laws and the Constitution of the United States,'' he said. ''Our courts should never be the wholly owned subsidiaries of any one political party, any one point of view, any one ideology or any one president.''
The speech came after Kerry last week helped Democrats block a vote on Miguel Estrada's nomination for a federal appeals court, dealing Bush a setback.
Kerry said Estrada has many qualifications for the position, but that Democratic opposition is a statement over concerns of what Estrada would do on the bench.
''It stems from the ideological nature of the nomination of where they are going with the court,'' he said. ''It is really trying to make clear the statement that we can't allow this kind of process with the declared intent to undo settled law as the purpose of the appointment.''
Republican Party spokesman Joel Hannahs said the Democrats haven't presented a good argument for their actions, and that Estrada deserves the nomination.
''The message is simply that Miguel Estrada deserves a fair up and down vote by the Senate,'' he said. ''Estrada is an American success story.
Kerry reminded the law students that judges are appointed for life and insisted there is no room for politics in the nomination process.
''Whenever one party attempts to run judicial decisions into political debates, it causes all of our fellow citizens to doubt the independence of the courts and to question even the law itself,'' he said.

Funny. That's exactly what his own party has been doing in the Miguel Estrada nomination and he has the nerve to accuse Republicans of trying to politicize the judiciary? Oy vey! What John F. Kerry is really afraid of is that if liberals lose their hammerlock on our nation's courts, the ball game is over as far as their agenda is concerned. They can't get the American people to vote for it so they need unelected federal judges to make sure they accept it whether they like it or not. I presume Kerry thinks the Nine Circus decision abolishing recitation of The Pledge Of Allegiance is exactly what the unwashed masses need to have forced down their throats for their own good. Nice to know he's honest about what's at stake for his party since if Estrada gets on the bench the Democrats last remaining clout will swirl down the drain.

On other words, we (the Democrats) will not allow a judicial appointment wherein the appointee woud overturn Liberal precedents. This an absolutely outrageous statement but it does state Demcratic intentions rather plainly. To the Democrats the Liberal activism from the bench of the last 40 years has effectively supplanted the Constitution.
Unbelievable.

Estrada's memos from the Solicitor General's office weren't really important to the Democrats.
According to Kerry, Democrats would have filibustered Estrada, in any case.

So, clearly Kerry's NO vote indicates he doesn't think Estrada is a patriotic American. BINGO! Someone should ask "Kerry" what he thinks is so unpatriotic about Estrada that he can't vote for him. Also they should ask "Kerry" what laws or section of the constitution that Estrada did NOT enforce. Maybe Freepers should show up at his campaign events and ask John F. (F for "Fraud") "Kerry" these questions
