Idiot GOP Senate Set to Shaft Estrada?

I am more frosted at the Democrats for what they're doing to the Constitution vis-à-vis Miguel Estrada's than I am over the anti-war movement. Fox News reported that the GOP planned to call for a cloture vote on Estrada next week knowing they'd lose it. That would effectively amend the Constitution - illegally - to read that you need 60 votes instead of 51 to get a judicial nomination through.

Happily, it turns out the GOP isn't going to call such a vote. The offices of Senators Santorum and Hatch rang up my office on Friday, and said that the Fox story is not accurate. There will be no cloture vote. Hooray! If these Democrats want to filibuster the first Hispanic nominee to the D.C. Circuit Court, let them do it! I know they say there are new rules making a filibuster harder, but so what? And don't tell me that it's not "practical" anymore, because people have to go to the bathroom. That's nothing new.

Force them to get out there and filibuster this eminently qualified man, as rated unanimously by the American Bar Association. Miguel Estrada is just a name to us, but his life is being destroyed here. It's not because he's unqualified; it's because Democrats don't like how he might think. Read George Will's column. Chuck Schumer didn't bother to ask Estrada a single question. He claims not to know any less qualified judge, when in fact he knows less qualified judges who went to the Supreme Court! Just this week, President Bush pledged to stand by Estrada until he was sworn in. We know no other nominee has been asked to give nor should give opinions on issues that may come before the court. Their job is to apply the law, not to make law or let their opinions get in the way of rulings.

These senators have to back Bush and Estrada up. The Democrat attitude is, "We ran Washington for 40 years up until 1994, and Bush is illegitimate despite what the Constitution says about the Electoral College, so he has no right to appoint anyone." These people are treating the Constitution like toilet paper. Calling a cloture vote would overturn more than two centuries of Senate precedent and rewrite the constitutional definition of "advise and consent." We cannot allow that to happen. You have to care about this, folks!

These people aren't Democrats or liberals. They don't believe in the Constitution. They don't believe in individual rights, as affirmed in the 9th Amendment; in sharing power with the states, as described in the 10th Amendment; in free political speech protected in the 1st Amendment and shredded in campaign finance reform. They don't support the right to bear arms provided for in the 2nd Amendment. They don't respect private property rights protected by the 5th Amendment! If there's a blade of grass in the backyard, they call it "wetlands" and take it away! This assault must stop.

I believe a real push to repeal the 17th amendment must be done too.

If we were to fantasize that this could really happen, how would it happen?

Would Congress actually pass an amendment that effectively nullifies the current Senate and sends them back to their respective states for appointment?

On the other hand, people get scared when there is talk of convening a Constitutional Convention because then everything is up for grabs.

So, how might that happen?

Since you quote my post, which was written immediately when Rush first announced the phone calls correcting him, I will respond. My post was not meant to encompass ALL that Rush said about it. In fact, reading the very next post:

Haven't had time to catch up with all of this thread yet, but Santorum's office just called Rush's office and said the Fox story was wrong -- no cloture vote Tuesday (Rush is glad) -- they did say some members are getting nervous about other business not being done. (Which members, Democrat or Republican?) And that they are trying to get as close to a "real" filibuster as possible although it may not be 24/7. Rush seems to be feeling a little better based on these representations. He's come down hard on the Republicans today which I hope will help encourage them to stay the course on Estrada. It's crucial.

See the word "wrong"? Fortunately the Republicans had no intention of backing down and aren't changing a thing due to Rush. (Who I AM a fan of, but this time he relied on only the one story and was under a false impression.)

What in the world is your hurry? Can you even attempt to explain that?

Because it would be nice to get other things done as well this year. Finish off the rats on this one and the rest will fall into place.

I am willing to drop the fight over the stories if you are?

Main thing is the Gop does not give in and we beat the rats at their game. Much is at stake and I have from as far back as the week of the 15th pointed out the constitution issue and that is what is as important as getting things passed that the President wants.

Someone told Rush the fox story was wrong and that was a lie, it was right when written.

The people who told Rush the story was wrong were Rick Santorum and Orrin Hatch.

This issue is where it starts and if Rush keeps up about the constitution part of it that is the starting point. The writers are already writting the stories and once the 24/7 starts and is all over the news is when we hit them with the 17th Amendment. Just an opinion of course.

The unanimity of the Conference has been and continues to be incredible. Sen. Hatch has been heroic, Sen. Frist has been steady, Sen. Santorum has outspoken.

Thank you for adding to the discussion.

Many of us have observed this with our own eyes. Plus President Bush's extremely strong statement of support for Estrada--I believe Wednesday?--was an indication of what he expected from the Senate. Many of us can see that the 24/7 option is one of last resort, and not one they will shy from using *if need be*. That time is not now.

Again, thanks for that insight.

It isn't starting again. If you want to discuss the issue of beating the democrats and repealing the 17th Amendment which is a Freerepublic goal then lets talk. If you want saturday night at the fights turn on your TV..

Yes it's all about him and his ratty rat buds....... I've asked him several times already if he's gotten finished with the dinner dishes and the kitchen cleaned up. But he want answer. He did take about 25 minutes at dinner but he's been here full time otherwise.

He also want tell me if he likes turnips. But he was bragging about salt taters, beans and yard bird earlier.

There was a turnip truck by here I believe in the last few days. I thought maybe he'd picked up a few.

Hey I've been to a few hog killings, several county fairs, lots of rodeos, and at least a half dozen goat ropings... but I've never in my life seen anything like him.
