He acknowledged there was little liklihood Cox would accede to the request that he resign. But, after hinting that Cox's stance may violate legal ethical standards, Hollowell said, without specifying how, that he might pursue the issue further.

Cox is not violating a legal ethical standard. Quite the opposite; he is simply refusing to file a brief which he knows would have no legal merit and is thus following the appropriate rule of professional conduct and Federal Rule of Civil Procedure 11.

Out here in Oklahoma, our AG went against Governor Keating and filed a brief in support of Al Gore!

That was probably okay because the AG here is a RAT!

Interesting. I had hoped for a similar response from our past attorney general in Ohio, Betty Montgomery, in the DeRolph case, in which the Ohio Supreme Court has essentially obliterated the separation of powers. Of course, our weak-sister governor (sorry, ladies) refused to stand up to the court's unconstitutional ruling, but the Ohio Constitution provides more than one directly elected executive officer, and the ag is one of them.

In other words, they all have independent duties to uphold the Constitution and challenge unconstitutional acts by other government officials. It's not like the federal government, where the ag serves at the pleasure of the president and must adhere to his policies (or resign).

Do you know whether the ag in Michigan is also directly elected and thus stands indepedent of the governor?

Good for Cox! He's one of the few good guys that one state-wide positions. Granholm is a mini-hillary

Did you all hear that Ohio AG Jim Petro refused to file a brief for Ohio State U in support of Big Blue's position? It seems Jim gets it: he has a duty to interpret the law for himself and act on it, not to just willy nilly take any position that any bouquet of bureaucrats wants him to take.

Please. Granholm hardly represented Engler when he was governor. She put her OWN politics above her job. Now Cox is showing that paybacks can be hell.
