Pickering presumably doesn't want a recess appointment, because he would have to give up his district judgeship to take it. I see no reason why Estrada couldn't be given a recess appointment.
There's plenty of precedent for recess appointments of federal judges at all levels. I am not aware of any precedent for filibustering judicial confirmations below the Supreme Court level. If it's ever happened, I'm sure it must be very rare.

They'll filabuster, but they need a reason to do so that won't make them sound obstructionist.....you recall in the hearing they went on and on again about the request for the work products from Estrada's time at the DoJ....so my guess is they'll announce a "filabuster" until they get the stuff...it's an attempt to reframe the issue, and grab the headlines.....

Hey, this is good news. Seems every time Daschle holds a press conference or delivers a "major address" it just blows up in his face.
If they want to filibuster Estrada, I say let them. They will look like the true obstructionists and vast left-wing nutcases that they are. It seems Estrada sin is that he is "friends" with Scalia, Rehnquist and Ken Starr. Not a very compelling case.

It really isn't a fillibuster unless some hapless sap takes the floor and begins to speak, without yielding and without stopping. I would truly enjoy hearing an actual fillibuster. All the silly crud and crap that the speaker would have to spew would be such tripe and trivia in these important days.
How stupid would the democrat mouthpiece look wasting valuable time debating with himself about the vagaries of cooking and gardening?

I agree. People aren't in the mood.....especially the Federal employees working at NASA today, and the entire military waiting for Mr. Powell's address.
