Park Ranger Cites Militia Leader, Seizes His Gun

A National Park Service ranger cited militia leader Chris Simcox Sunday for carrying a loaded weapon and operating without a permit at Coronado National Memorial in southeastern Arizona.

The chief ranger at the park south of Sierra Vista, Thane Weigand, said it appeared Simcox and William Dore were conducting a patrol of the border. "They were doing a special activity inside the park that's not sanctioned by the park," Weigand said.

Simcox, founder of the Tombstone group Civil Homeland Defense, has been conducting citizen patrols of the border area, but he said that's not what he was doing Sunday afternoon. He said he was simply hiking with Dore.

They were driving along Border Road when they came to a fence with a sign that said no vehicles were permitted, Simcox said. So they parked the van and walked past the fence along the road, not knowing the fence was the park boundary, Simcox said.

"Next thing I know, there's somebody waiting in the bushes for us," Simcox said.

It was a park ranger, who said she had been watching the pair, knew who they were and what they were up to, Simcox said. He and Dore were detained for about 3 1/2 hours, and some belongings were seized, Simcox said. Those belongings included a scanner, two two-way radios, his camera, a cell phone and his pistol.

Weigand said the charges against Simcox and Dore are misdemeanors.

Eleven illegal Mexican immigrants were arrested and charged yesterday with possessing false documentation. The other immigrants are still at large.

How many times did the USS John F. Kennedy blow up, Joe?
They should be deported, but this hardly backs up your thesis.

You ever notice it's generally the same individuals that come out in support, of or attempt to minimize this epic crisis? Jezzz, I don't know who these guys are. Neocons? Government employees? DMV desk jockeys? Leftist? LOL!

It's like America getting beat over the head by 15 million criminals, and if one American stands up to fight off this brutal attack, he gets speared by these same individuals.

With a couple of these individuals, I feel like I am selling American flags at a Ali Baba rally in downtown Bagdad.

Come on down here and tell when you're in Coronado. Unless you're on the main road or carrying a GPS and know the lat-long, you wont have a damn clue.

Interesting quotes you posted (in #'s 193, 194, 196). Unfortunately, they don't support your position for several reasons.
  1. They do not quote Mr. Simcox as saying that he intended to carry firearms onto public property. (which appers to be the core of the charge against him.)

  2. They do not quote Mr. Simcox as saying that he intended to patrol on National Park property, only public property, generally.

  3. Even if the crime he is charged with is a "general intent" crime (the best case for your position), the lack of notice as to where the park property began would be a bar to prosecution under 5th and 14th Amendment, "due notice" grounds.
The case (as best as we understand from the information posted) would never even get past arraignment, as any competent attorney would file a motion for Demurrer, stating that the government's complaint failed to state any notice that defend could reasonably rely upon to know that he was, in fact, entering National Park property.

Even if the judge were to allow those quotes to be entered into evidence, that would be at time of trial, and as I explained, the Demurrer would prevent the case from ever reaching the trial phase.

Elsewhere he publicly stated that his group would be armed with pistols and he dared law enforcement to arrest them on public lands, ostensibly Park lands in that area. This constitutes not only a mob, but an armed mob. As such they can be considered as enemy combatants under anti-terrorism laws.

Even if you had a quote of him saying "National Park" lands (and your use of "ostensibly" suggest you don't), and even if you could convince a judge to admit such evidence, the case would never get that far, because it would be dismissed after the hearing on the motion for Demurrer on 5th and 14th Amendment grounds.

Again, I have to disagree with you, CJ, especially your characterization of the citizens border patrol. This is neither a "mob" nor a "vigilance" committee. Notwithstanding this current dust up over possessing a gun on National Park property, this is a group of citizens exercising their lawful right to effect a citizens arrest and to inform law enforcement of crimes in progress.

They haven't taken up arms against the government, only against criminals. They are entitled by law to do so. I have made an armed citizen's arrest, CJ. Am I an enemy combatant, too? If you had helped me effect that arrest, would we be a "vigilante mob"? To compare such otherwise law abiding citizens, as the citizen's border patrol, as being actual enemy combatants like "Johnny Jihad", is (in my mind) a defamation you should be ashamed to make.

Great, The Border Protectors don't know where the hell theborder is located.

They knew where the international border was. They didn't cross that. They crossed the boundary of the national park. The international border and the national park boundary are two different things. Understand?
