Park Ranger Cites Militia Leader, Seizes His Gun

A National Park Service ranger cited militia leader Chris Simcox Sunday for carrying a loaded weapon and operating without a permit at Coronado National Memorial in southeastern Arizona.
The chief ranger at the park south of Sierra Vista, Thane Weigand, said it appeared Simcox and William Dore were conducting a patrol of the border. "They were doing a special activity inside the park that's not sanctioned by the park," Weigand said.
Simcox, founder of the Tombstone group Civil Homeland Defense, has been conducting citizen patrols of the border area, but he said that's not what he was doing Sunday afternoon. He said he was simply hiking with Dore.
They were driving along Border Road when they came to a fence with a sign that said no vehicles were permitted, Simcox said. So they parked the van and walked past the fence along the road, not knowing the fence was the park boundary, Simcox said.
"Next thing I know, there's somebody waiting in the bushes for us," Simcox said.
It was a park ranger, who said she had been watching the pair, knew who they were and what they were up to, Simcox said. He and Dore were detained for about 3 1/2 hours, and some belongings were seized, Simcox said. Those belongings included a scanner, two two-way radios, his camera, a cell phone and his pistol.
Weigand said the charges against Simcox and Dore are misdemeanors.

So where in the Constitution does it give the Federal government the power to make such a regulation? Even gun grabbers like Roscoe affirm that the FedGov is prohibited from passing such restrictions. This should go to court and these two guys should win.Until we get an affirmation from SCOTUS that the 2nd A is an individual right, that's a very uphill battle. And even then, landholders have the right to restrict weapons on their premises - a bar, for example, can prohibit guns. So the NPS could probably just say they were restricting guns as a landholder (I'm not agreeing with them, just debating the point).

National Parks aren't covered under the Constitution. The Founders never envisioned them so the Constitution doesn't apply there.

Not just anyone, Corpse. But...I don't fight losing battles. If a cop, at gunpoint, wants my stuff, he/she can have it. I'll take it to court later. I'd prefer being a live man without some stuff than a dead one. That's my choice. You can choose your own course under such a situation.
Don't misunderstand choosing an expedient course of action with being gutless.
But, you're free to do as you wish.

%uck the SCOTUS. They won't do it and you are dreaming if you think they will. Even if the President can manage to get any Judges seated. They'd just give the "rock the boat" argument and pan any such decision back to the States just like the dodge they put on the Emerson case.
Private landholders, yes. This is "federal property", and as such subject ot all the Constitutional provisions and restrictions. Ie; no legal restrictions can be placed on firearms carry.
Period.
If you are waiting on someone else to hand you back your Rights, you are not only thinking about your Rights the wrong way... but you are going to have a LONG wait ahead of you.

Gutless wonders who won't fight for their Rights are why we are in such bad shape these days.You've got a lot of nerve calling those two guys gutless. They're out there in the desert at night, facing coyotes and drug runners and natural hazards, trying to drive the debate over illegal immigration, and all you can do is bitch at them because they didn't have a shootout with a uniformed Park Ranger? Situations like this are why we have courts - and it seems the ranger may have overstepped her bounds here.

Also, not reported, was that the female park service officer that stopped these hikers held a gun on them. I'm trying to get confirmation from Simcox himself, but apparently the female agent was of hispanic descent and she stated to the hikers that she "doesn't agree with what [they're] doing."How often are Park Rangers arresting illegal border crossers for the trash dumps they create? These creeps are ravaging our national parks on the border.

Having a shootout with a Park Ranger is no way to promote 2nd Amendment rights. If you want to make an ass of yourself, go right ahead, but I prefer to channel my engergies towards making an ass of the park ranger in question.

Given the general conservative nature of farmers, ranchers, and other large landowners, though, I wonder about that statement that most ranchers don't want these folks on their property. There's something here that's not being said.Like what?
There are plenty of folks who I love as brothers and sisters in Christ...whom I would NOT allow onto my property if they are carrying weapons. This says far less about their character than it does about my perception of their ability to safely handle firearms.

Fortunately, most 2nd Amendment advocates would not have that shootout, either. Neither, I suspect, would Dead Corpse. At least these AZ folks are out trying to get some action on the illegal immigrant problem. That's their battle, and they're certainly getting some attention.
By being smart, they're succeeding in bringing the problem into focus, and are getting national mainstream press coverage. Of course, having a shootout with a National Park Ranger would probably get significant coverage, too, but perhaps not the kind they want.
Now, if Dead Corpse is out there on the front lines of this or any other battle, I'd like to hear about it.

If the ranger had tried to arrest illegals, they would have killed her. Or worse, since they are criminal non-citizens, they would have gone to court and screwed her and the dept to the wall.

And if I lived closer to the Border I'd be out there with them.Heck, you live in Austin. It's about a four-hour drive, I believe, to the border. Used to drive some down that way myself and saw lots of illegals walking along the roads. Organize a group, contact some private landowners (not much public land in Texas), and start a patrol. If you want to make a 2nd A stink, go to Big Bend National Park and carry a gun. Lots of opportunities for someone from Austin to help out here...
