You're exactly correct. In some circumstances the coal bed water is fresher than the above acquifers, but that doesn't make for good scare tactics.

BTW, depending on whether EPA or the state has Clean Water Act jurisdiction in Wyoming, putting this under the CWA (and thereby requiring a federal NPDES permit) could effectively end production. There is a general EPA NPDES permit for oil and gas produced water in effect for the states which has a "no discharge" requirement to "waters of the US". I don't know whether the permit could be modified for discharge of coalbed methane water. However, in Region 6 in NM most of the water is reinjected or evaporated, both because of poorer water quality and because the program is under EPA in Dallas which doesn't have the staff to process the permits!
