Why not capital murder. If walking out on a restaurant tab could be prosecuted as felony theft, this homicide could be considered as being committed while in the act of committing a felony which can be prosecuted as first degree murder.

My guess is that a sizeable portion of that $100 tab was for alcohol. They're all underage, and this Bennigan's is probably as strict about checking IDs as all the ones I've been to.
More likely, IMHO, they a) wore black; b) had more than one facial piercing apiece; and c) there was at least one with hair dyed black.

I can tell you that official restaurant policy means nothing.
The management team ALWAYS will make servers pay for dine and dash, as their bonuses are reflected on the basis of them (profit, etc).
May some smart lawyer light these bastards up like a pinball machine.

Three of the car's four occupants were later arrested for aggravated assault and police said they expect to make an arrest for the fourth occupant. Try murder cops.

They were arrested on those charges before the woman died. The charges will undoubtedly be upgraded to either murder or reckless homicide (depending on what the interrogation reveals).
