Sentencing Set for Friday in Danielle van Dam Murder Case

SAN DIEGO — A jury has already recommended convicted child killer David Westerfield be given the death sentence in the February 2002 kidnap and murder of 7-year-old Danielle van Dam.

On Friday, Judge William Mudd is scheduled to decide his fate.

If Mudd follows the jury's recommendation and sentences the 50-year-old engineer to die by lethal injection, Westerfield would be the 617th inmate on California's death row.

The judge could opt to sentence Westerfield to life in prison without parole, an option legal observers said was unlikely.

In motions filed last week, prosecutors said there was no justification for anything less than the death penalty for such an "evil, selfish, cold-hearted child killer."

"Civilized society cannot contemplate the enormous cruelty shown by the evidence in this case," prosecutor Jeff Dusek wrote.

I sure hope no kid ever gets killed within ten blocks of my home, or I might be sentenced to death too.

Find a neighbor and frame him.
