WASHINGTON — The last cryptic message from Montgomery County Police Chief Charles Moose to the Washington-area sniper referred to a Cherokee Indian story about an arrogant rabbit that was duped by the duck he tried to catch.

"You have indicated that you want us to do and say certain things. You've asked us to say, 'We have caught the sniper like a duck in a noose.' We understand that hearing us say this is important to you," Moose said late Wednesday at a televised news briefing, called so authorities could release information on two people sought for questioning in the 13 sniper shootings.

In the ancient story, passed down through generations of Cherokee Indians, a rabbit brags that he can catch a duck. He throws a noose over the neck of a duck, but it flies away with the rabbit hanging on. Eventually the rabbit must let go, landing in a hollow tree stump. The conceited animal has to eat his own fur for food and is embarrassed by his appearance when he finally escapes.

"His boastfulness got him in trouble and eventually destroyed him," said Tera Shows, spokeswoman for the Cherokee Nation, based in Tahlequah, Okla.

Ultimately, the killer blamed for shooting 13 people, 10 of whom died, around Washington over the last three weeks may be less duck than rabbit, Shows said.

John Allen Muhammad, 41, and John Lee Malvo, 17, were arrested Thursday morning for questioning in the killings.

"It does look like [the sniper] maybe is the rabbit," Shows said.

NEW YORK — Maryland prosecutors can seek the death penalty for the sniper despite an existing state moratorium on executing Death Row convicts, officials said Thursday.

"They can be given the death penalty, absolutely," said Chuck Porcari, spokesman for Gov. Parris Glendening. "There is a temporary moratorium on the executions, not on the death penalty … they can absolutely be prosecuted and given the death penalty -- no question."

Maryland's moratorium currently affects only three or four people in the state currently on death row, Porcari said. But the moratorium would not prevent a jury from sentencing a killer to death, officials said.

Thirty-eight states currently have a death penalty. But some of those states -- Maryland among them -- have ordered moratoriums on executions in recent years because of various concerns.

The Maryland moratorium is in place while University of Maryland criminology professor Ray Paternoster prepares a report, commissioned by Glendening in 2000, analyzing the application of the state's death penalty. Paternoster has until Dec. 31 to complete the study, which will then be turned over to Maryland lawmakers for review.

But the moratorium "is pretty much unofficial," Paternoster told Foxnews.com on Thursday. "It could be lifted … there's nothing preventing the state from sentencing them to death."

State attorney Douglas Gansler believes he can more easily argue a case for the death penalty than a Virginia jurisdiction, The Richmond Times-Dispatch reported, because six people were killed in Montgomery County.

"We have every intention to seek the death penalty," he said.

The capital punishment issue has fanned the flames of Maryland political debate in recent years.

Lieutenant governor and Democratic gubernatorial candidate Kathleen Kennedy Townsend supports the death penalty, in limited cases. Her opponent, Republican Robert Ehrlich, said this summer that if elected, he would repeal the moratorium and establish an executive review process to evaluate every death penalty sentence.

I thought it was a white male but it appears I was too cautious. Two snipers are highly unusual since psychos usually work alone so this one now looks like a case of domestic terrorism. Yeah you have the ransom angle there but the usual "Death to America" political component that accompanies Islamonazi terrorism was missing. Perhaps that turned out to be the point since the shootings, like the planes slamming into the buildings on 9-11, were their own message. I concur its time to find out who they were working for. And if in fact the suspects now in custody are the snipers the Religion Of Peace mantra is knocked down another peg.

I think these two had a somewhat different relationship than a father and son. More like a "daddy" and his "boy" as they call them in a certain community. It will be interesting to see if these two, who are obviously members of a couple of communities that typically vote Demo, are also members of an additional Demo community.
