I agree. Although the New Jersey statute appears to allow for McGreasy to appoint another Senator if the Torch resigns and postpone the November election, the statute directly runs afoul of the United States Constitution and federal statutes, which would take precedence. It might, however, result in the case ending up in the federal court system and the SCOTUS at some point.
Something everyone should keep in mind as this case originates in the New Jersey Surpeme Court is that although the New Jersey Supreme Court has a large majority of justices appointed by Republican Governors, they are NOT in any way, shape or form conservatives. In fact, they don't even approach RINO status on the ideological scale...

If the above is cited correctly, they are toast. The key is him not resigning.
Is it possible that he double crossed those that attempted to squeeze him out? Was he suppose to resign today so the governor could appoint a replacement, but he decided to get back at them by not going?
Rush always said liberals were fun to watch when they were out of power, and he is right.

He is now respected for this and then reelected for his stance on the "issues". More evidence of gaming the elections. For it to work, the pols must think that voters are really really stupid. I don't think they're that stupid. I think this is "inside the beltway" thinking that clouds people's minds into believing anything is possible.
