Hi, I'm Bill O'Reilly. Thank you for watching us tonight.

An absolute disgrace in the murder trial of 7-year-old Danielle van Dam. That is the subject of this evening's Talking Points memo.

According to a report in The San Diego Union Tribune, convicted killer David Westerfield's attorneys, Steven Feldman and Robert Boyce, knew their client was guilty.

Jack Ruby killed a man on national television, pretty difficult to refute that evidence but he was given and deserved a defense to make sure his rights were protected, which is what Jack Ruby received from Joe Tonahill and the rest of the defense team.

I would have voted guilty based on the fingerprint evidence alone but I've worked in law enforcement for some 20 odd years

Well we all come with different life experiences. My son-in-law is LEO in San Diego County and told me of some of the sordid stuff as soon as the story broke.

He has LE friends all over the county. You can take it FWIW, but there are more than a handful of cops that aren't exactly certain of Westerfield's guilt.

if anything, they will be forced to admit whether or not there was a plea deal to the state bar, right? Will the results of the investigation be made public?

I guess time will tell, but as of this moment we don't know anything for certain and the only source O'Reilly gave was the quote from one newspaper. It's not exactly overwhelmingly convincing.

Even though there may be something that attracted DW to the victim because of the parents' lifestyle, it does not negate he did it.

If your son in law is LEO in San Diego, does he say all the blood, hair, and fingerprint evidence can be easily dismissed?

BTW, I worked in LEO in San Diego but it was awhile ago...

Yet it would be a downright lie of your lawyer said to the jury you were not even in the room when you had been.

Even the Prosecutor said they did not know how he did it. Dusek also said they didn't have to prove it.

Really? Were you around during the Dale Akiki case? That one will bother me forever.

As for my son-in-law's opinion of the details.....we never discussed it. He said very little after the intial stories of the lifestyle. But after the verdict, he said that I was not the only one that had doubt; plenty of cops did too.

Then why were there forensic entomologists who provided that evidence. The first one was originally hired by prosecution. BTW, the DA's office has used Faulkner to confuse juries in 196 other trials with success.

Perhaps, but he has gotten to be awfully high on himself and a little too Geraldo-ish for me. I turned him off months ago.

Saw this interview..got the following quotes from another forum.

"Raymond Winkowski, Juror, Sep 18, 2002 on National TV:
How Could He (Feldman) LIE to Us for 4 Months?""


Juror says that Feldman and Boyce lied to the jury. Also noted how Feldman claimed the pros were "spinning" while he was the "spinner". Andrew Napolitano is encouraging everyone in the US to file an ethics complaint againt Feldman and Boyce. You can go to the website for www.calbar.ca.gov to download the complaint forms.
Bill Oreilly has also filed a complaint. The Factor tried to interview Feldman and Boyce but Feldman just screamed and Boyce kept trying to tell the reporter she was no Walter Cronkite. He also said the interviewer should not come to his home and videotape him in his underwear but he was fully dressed and walking into his OFFICE, not his home. More lies..... Anyone surprised?

It appears anybody can file a suit... You don't have be an aggrieved party or such...

That's why I'm saying, I don't think he's filing the complaint with just a newspaper clipping in his hand...

With what standing?

The juror is of course responding to what sounds like a thirdhand report, which was aired just for this effect (to dry up as much public sympathy for Westerfield as possible to minimize the impetus behind continued investigation to turn up more evidence to bolster an appeal). No version of this report carries a direct attributable quote from a detective.
