Two Men Charged With Raping 11-Year-Old

NEW BEDFORD, Mass. -- Two men were charged with raping an 11-year-old girl after a night of drugs and drinking in a West End apartment.

Michael J. Duarte, 24, and Eric Tavares, 20, are accused of raping the sixth-grader in Duarte's third-floor apartment at 593 Cottage St.

The girl's mother told News Channel 10's Martin Morenz that her daughter had alcohol poured down her throat until she lost consciousness. She said the girl's clothes were burned and that she was repeatedly raped.

Duarte was released Wednesday night after posting a reduced bail of $5,000.

The girl was treated at Hasbro Children's Hospital in Providence and released.

The girl's mother (pictured with News Channel 10's Martin Morenz) said her daughter claimed she was going to a sleep-over at a friend's house the night of Aug. 10, but instead left with a 17-year-old girl.

The two girls ended up in Duarte's apartment, where he said he and two other men were drinking and smoking marijuana.

Duarte said the 11-year-old told everyone there she was 16, and played drinking games with Tavares and a neighbor.

Duarte told Morenz that he went to sleep and when he woke up, the girl and Tavares were asleep, naked on his living room couch.

Tavares, of 60 Merrimack St., remained in custody Wednesday night and could not be reached for comment.

Duarte said the girl had burn marks on her body and that his friends tried to burn her clothes to get rid of any evidence.

The victim's mother called to check up on the supposed sleep-over, and when she discovered the girl had not been there, she called the police. She said when her daughter arrived home, she screamed at her about lying and about sneaking out.

According to the mother, Duarte did more than see his friends with the girl, he "did everything to her, he took my baby's virginity."

"Burned her with a lighter, burned her clothes, poured alcohol down her throat until she passed out, then he took turns raping her," she said.

The mother said she seeks justice for her daughter, she said "they took a part of me I thought no one would ever take, and they took my baby, she's 11 years old."

Judge Turcotte originally ordered Duarte held on $100,000 bail on charges of aggravated rape, performing an unnatural act with a child and providing liquor to someone under 21.

Superior Court Judge Nonnie S. Burnes reduced his bail to $5,000 on Tuesday.

Tavares was being held Wednesday night in lieu $50,000 bail. He is charged with aggravated rape and providing liquor to a minor.

I think the perps are being unfairly persecuted by an out of control legal system. Now I have to go and compose some DumbA** song lyrics to post so other idiots that think sad situations like this are an opportunity for amusement can have their fun.

With a name like Nonnie maybe it's a woman?

Nonnie is a woman. She is married to a big venture capital guy Richard Burnes. I think she may have gone to Wellesley, not sure. Has a place on Beacon Hill near Senator John Kerry and has a summer place (a very, very nice one) in Osterville.

Sounds like the girls were looking for some action and found it. They planned a sleep over with thoes guys and ended up in a night of drugs and drinking. The 11-year-old lied and told everyone there she was 16 and played drinking games( this doesn't sound like she had alcohol poured down
her throat). Com'on people, the girl and Tavares were asleep, naked on the living room couch. It was rape 'cause she was 11 but when she got there the men were drinking and smoking marijuana already and she didn't leave, she stayed. The mother said when her daughter arrived home, she screamed at her about lying and about sneaking out. Looks like to me the girl wasn't going to say anything about the rape. There's more to this that meets the eye.
And I'd like to know what mother that's concered about her "baby's virginity" lets an 11 year girl old go to a sleep over BEFORE first checking it out with the sleep over family?

Why was an 11 year old girl not under the supervison of her parents? Parents had better wake up and start making sure they know where their kids are and what they are doing!

You are cold. Probably exactly right, but still cold.

I'm sure there is more to the story, but I don't think there is much to mitigate what these slugs did to an 11 year old. The older girl has a lot to answer for also.

That was my thought as well upon first reading this story.

Judge Nonnie should be recalled. This is an outrage. Wonder if she has any skeletons in her closet that make her a mark for blackmail.

Right you are. New Bedford has a large Portuguese-American population. The pool-table rape at Big Dan's tavern in New Bedford where the bar patrons supposedly yelled "Go for it!" was immortalized in the Jodie Foster movie The Accused. (It's unlikely that they shouted any such thing, since it was a Portuguese bar and few of the customers spoke English.) Hustler may very well have been accurate, although I don't care for it or its proprietor. Tavares is a Portuguese name and Duarte is Spanish. If I've offended any readers of Portuguese descent, please allow me to state that the lowest and most toxic form of life in this story is the WASP liberal judge who reduced the bail.

Sounds like the girls were looking for some action and found it.

Understandable thoughts, but it still goes back to these guys were scum. No matter how this pans out it still does not excuse their actions. Perhaps both parties are guilty to some extent - but these guys could have kept it in their pants, not been boozing, and not been getting high around young girls.
