I just heard this at noon.
Wanted to escape the death penalty, or LIP with possibility of murder at the hands of fellow inmates by pleading innocent.
But, I don't know. I haven't even had the stomach to follow the case, so I am not familiar with a lot of the details, but two things bother me. One is that he snuck in, drunk as a skunk, and pulled off a remarkably clean rape and murder. Two is that the prosecution had to stretch things pretty badly to explain away the blowflies, which are pretty dang reliable six-legged witnesses with no dog in the fight.
That is a piece to the puzzle.
I assume you mean "DW", not our President. I can't say for sure if it was DW, but it wouldn't surprise me to find out eventually that D is the daemonic perp's first initial.
These parents did not protect their child...doors were left open, alarm lights were noticed, but noone checked on the kids.
They reversed the lock on their garage door which made access VERY easy for ANYONE WHO KNOWS THEM.
They brought back drunk, stoned "friends" at 2 am, while their children were asleep in the house.
All in all, I would say that they are unfit parents, regardless if DW did it or not.
Those remaining children are at risk. Obviously, the parents do NOT know how to protect their children.
That is a piece to the puzzle.
It is not a puzzler. If truth_seeker is correct, then I was correct on my posts last week.
Many, many of the posters on the forum who believed in DW were misconstruing the jury and their evidence requests. These posters were incorrectly thinking that the jury had considered murder/kidnapping then moved on to porn.
This discussion took place last Wed., I believe.
I pointed out that the porn evidence had been requested by the jury on Friday. Then Monday afternoon the Redden tape was requested, then the Redden transcript was requested Tuesday morning. I pointed out that therefore it stood to reason that the porn charge had been dealt with and they had moved on to the murder/kidnap charge.
Evidently, according to truth_seeker, they did indeed sign that verdict form on Tuesday as I had surmised.
Very simple and logical.
Exactly. Making an automatic assumption of reasonable doubt just because of the lifestyle of family members of a crime victim is not simply not warranted. It denies the victim justice from the word go without even considering the evidence in the case.
No, I have never seen that. I have never known of blow flies exhibiting that behavior. Of course, just because it isn't known, doesn't mean you did not witness it. If that's what you saw, it would be very intriguing to many entomologists, I'm sure.
But are you sure you did not see a parasitic Tachinid fly giving live birth to maggots. Some species of Tachinids do that, and they look very much like house or blow flies.
Do you remember exactly what you witnessed?
He's sat through a lot of cases while on the bench. Why would he say that if the evidence was so poor? His comments always seem so sensible, and he seems to have a good head on his shoulders along with his experience. I have found his comments to be both reasonable and persuasive on FOX News all along. Why would he be so far off on this one?
I am surprised that at least one juror did not hold out based on the bug evidence alone. I think the emotions of the jurors had regarding the porn overwhelmed their collective sensabilities and reasoning related to bug evidence. If DW did just breakup with his girlfriend, it does not surprise me that he would wonder around for a day or two in his motor home. A guy that likes relatively slim, big-busted women does not all of a sudden take a sexual interest in a little girl. It make no sense to me.
Like you, I am not totally convinced of his innocense, but I am convinced the prosecution did not actually prove its case beyond a reasonable doubt; not even close. This is one case in which a hung jury may have been the best result. It is also a good argument against the death penalty.
Never mind; a little bit of reading on my part answered the question.
Just as it is strange that a plastered DW entered the home so stealthily and nabbed the child, it is strange, on the other hand, that a plastered DW suddenly went for a long road trip that night. I have gone on sudden, solo road trips before, but I was never plastered.
Another problem for DW is the blood on his jacket. Hairs in his motorhome might be explained away by the child entering it unbeknownst, but how the heck did he get her blood on his jacket? It is fishy that he was thoroughly cleaning everything at that time, as well.
But the maggots are still a problem for th prosecution.
I just think the whole picture is not being painted, here. If DW was the perp, and I can see some of the reasons they suspected him in the first place, it seems to me, queasily, that other people were somehow involved.
Did the cops know whether or not the porn DW had could have been MADE by him?
Well, the trial is OVER. The punishment phase is soon to start, options being life in prison, or death. It is pretty much OVER for Westerfield.
He will be behind bars for years, even if sentenced to death.
The SaveDave thread on FR will now be sure to last for years, pending appeal, of course.
