Judge Mudd was not a push-over marshmallow like Judge Ito in the O.J. case. High-powered defense attorneys can and do turn any trial into a zoo if the presiding judge permits that. Remember the purpose of defense attorneys in criminal cases: It is not their job to "prove the defendant innocent." It is only their job to create a cloud of confusion, like the ink cloud of a startled squid in the ocean, so their client wiill get off in the midst of it.

What was the outcome on the perjury case? Did you find the defendent innocent?Nope. The guy abandoned his wife and kids, then filed for divorce in another state, swearing under oath that she had left him and he didn't know where she was. All along, he was mailing birthday cards to the kids. Guess how we voted.

It's done. Everybody should be happy.
Those who believe that justice is served will be glad to see this man go down , while those who have a pathological need to cast doubt on every official version of a crime will get to discuss and thrash this around for the next 2 years.
DNA technology is wonderful. Occasionally, a really skilled smoke-blower like Johnny Cochran can get around it, but it usually does the trick.

If Westerfield is guilty (and I think he may well be), then I want to make certain that Law Enforcement, who are paid from our hard-earned money, do their job. I do not believe that either LE or the prosecutor did their job adequately and as a result, society is a little less safe for all of us now. Even if DW IS guilty, if anyone can be convicted on sloppy evidence, then all of us are in more danger. That's the reason our founding fathers set up presumption of innocent until proven guilty. If DW is guilt, I want to see better evidence. Instead of us attacking each other, we should be directing our comments and concern to LE in San Diego.

If Danielle was in his house while she was alive, why didn't Westfield present testimony to that fact? He didn't because he couldn't. Did you follow the case at all before today?
The defense did present evidence that Danielle was in his house before, and the prosecution agreed to it. Danielle and Brenda were in his house when they'd come by to sell girl scout cookies, and they came in to look at the kitchen remodelling he was doing. According to the VanDams, Danielle and the boys stayed by their mother's side during the visit, while the defense claims they roamed throughout the house and upstairs.

Guilty? Wait, I thought he was obviously innocent because the poor girl's parents were swingers and they smoked the Devil's Weed. Surely this is tragic. </ sarc >
You nailed it! If it weren't so tragic a subject, watching the anguish of these confused, zealotly pre-occupied whacks would be a hilarious hoot! A despicible murderer was found guilty by a court of law and these horrid souls are disappointed the parents can't be punished anymore. Ask me and I'll tell you that the parents have suffered more than westerfield ever will. I hope they'll be able to smoke some pot to dampen their pain.

I predict DW will take the stand on appeal. Take if from a Lawyer. You can't take the stand on appeal. The appeal is only to determine if there has been a violation of statutory or case law in the proceedings or there is a finding that the evidence was not sufficient to find guilt. In this case there is the little problem of the UNEXPLAINED presence of the victim's blood on the murderer's clothing.
If he thought he could have explained that, he had his chance at trial. He didn't try to explain it. That's because the only explanation is that HE'S GUILTY.
He will not be given an opportunity to take the stand on appeal. No one is ever given that opportunity. Dream on. Your favorite Child Rapist Murderer is Guilty. He will stay Guilty. There is not a snowball's chance in hell that this verdict will be overturned on appeal. I would be willing to bet my house on it.
You'll just have to move to San Quentin if you want to fawn over him. Maybe if you're real nice he'll invite you to the needle stick party.

Well Westerfield didn't get on the stand to present testimony to contradict what Brenda Van Dam presented did he about where she was in the house in relation to fingerprint evidence... Why didn't he?

Sometimes, after reading how these death penalty appeals drag on for years, if not decades, I often think it might be better to give the guy life without parole and give the victim's family the millions that are being expended by the state in the appeal process, including the cost of the defense........but that's what the opponents of capital punishment want....to make a travesty of the process.....so, the game contines afoot..
