Ex-Phila resident Class is arrested
A former New Philadelphia resident, who last week defended the actions of an outspoken constitutionalist accused of killing a Massillon police officer, was taken into custody at Dover Monday afternoon.
Dwight Class, 51, of Canton was arrested by Dover police as he walked toward McDonalds Restaurant on Davis St. about 3:50 p.m.
Class was arrested on a warrant from Perry Township police at Massillon. The warrant, according to police in Dover and New Philadelphia, was for failure to appear.
Dover police were assisted at the scene by three New Philadelphia officers.
A Dover officer said the arrest was made without incident and no weapons were found on Class or two men with him. Information from Stark County authorities had indicated Class was armed and dangerous, one New Philadelphia officer said.
Class was turned over to Perry Township police, but a dispatcher at the Perry Township department said Monday night that she couldnt release any information as to the arrest or the charges.
Class, who last week attended calling hours for Donald Matthews, president of the National Constitutionalist Academy, said Massillon police officer Eric Taylor and other law enforcement officers who were part of a police chase Aug. 9 did not have the authority to pull Matthews over on a traffic stop.
Matthews, whom a state trooper said was going 12 mph over the speed limit, was pursued to Massillon where a shootout ensued. One of Matthews bullets killed Taylor. Three bullets fired by police killed Matthews.
A Dover police officer recognized Class at the McDonalds parking lot Monday and knew there was a warrant for his arrest.

Constitutionalist faces $100,000 bail

Bail has been set at $100,000 for a Perry Township man who was part of the same Constitutional study group as Donald W. Matthews, the Jackson Township man who shot Massillon Police Ptl. Eric Taylor.
Dwight Class, 51, of 2913 Colony Woods Cr. S.W., was arrested Monday afternoon by Dover police near a Davis Street fast-food restaurant.
Class, who used to live in New Philadelphia, had defended the actions of Matthews in other area publications.
He was arrested on warrants from the Perry Township Police Department on two charges of driving on a suspended license, one dating from May 15 and the other from Aug. 13 of this year. New Philadelphia police assisted Dover police in the arrest.
Massillon Municipal Judge Edward Elum, who set the bail, said the police officers were probably wise to take precautions to ensure their safety while arresting Class.
"I know," Elum said, "the header on the LEADS (police) computer printout on him states something like he (Class) is known to carry a weapon, dislikes police and will flee."
Elum set a high bail for Class, in part, so he won't have the chance to flee. The standard bail schedule for Stark County residents who are arrested in the county for such an offense would be $1,040.
"He has a complete aversion for court orders," the judge explained. "He failed to appear for a pre-trial here (Massillon Municipal Court) and for appearances in Tuscarawas County court. He doesn't recognize any local courts. He has made it clear that he wasn't going to appear in court."
Elum said Class has filed frivolous documents with the courts, including a claim that the fringe around the flag signifies a military court and therefore has no jurisdiction over him.
"Those documents were without merit," Elum said, "and the most recent documents he filed were returned to him by the clerk."
Another reason Elum set a high bail, he said, is that Class disregards the rights of other motorists. "He drives without a license and without insurance," Elum said.
The judge noted Class has been cited only once by an officer for driving under suspension. The second time Class was simply observed driving a vehicle by officers in an unmarked police car. At that point, a probable cause complaint was filed. Sgt. Rick Wiseman, with the Perry Police Department, said officers in that department are being more cautious with those known to associate with such groups.
Class told a reporter at calling hours for Matthews that Taylor and other law enforcement officers who were part of a police chase Aug. 9 did not have the authority to pull Matthews over for a traffic stop. A traffic stop for 12 mph over the limit by an Ohio State Patrol trooper started the sequence of events that led to the shootout near the intersection of Cherry Road and First Street Northwest in which a bullet fired from Matthews' gun killed Taylor, according to reports. Matthews also died in the incident. Class will remain in the Stark County Jail until he can post bond or his jury trial, set for 8:15 a.m. Sept. 5 in Massillon Municipal Court

Looks like he has proved his personal irresponsibility, and deserves the higher bail.

"He drives without a license and without insurance," Elum said. American citizens are the only ones required to drive with a license and insurance. They know the illegals almost never drive with insurance and they leave them alone.

While illegal immigration is an important issue, it has no bearing on this particular court case. One can just see Mr. Class's defense lawyer, FITZ, Esq. before the judge: "Your honor, we wish to enter a plea of innocent, because all illegal alien drivers are guilty."

Looks to me like a muni judge may be getting way out of line on this matter.
Lets hope that this judge is not 'part of the problem' in this area.
And reading between the lines in news accounts of this flap, *some*thing seems to be driving these radicals. -- It could be a corrupt local political/justice system. - Time will tell, maybe.

As many here at FR have noted over the years, - the traffic safety codes are being abused for a great variety of 'citizen control' reasons. -- Power corrups, & we've given local authority too much power in the 'traffic law' area, imo.

I wonder who the two men with him were?
Maybe they were going to ask the McDonald's if they could hold their Constitutionalist meetings there.
Denny's, kicked them out after their leader, Don Matthews, killed a police officer.
