CA Gun owners: AB 2580 In committee (CA-DOJ random search of gun owners)

The California legislature has a bill in committee at the moment that's aimed at citizens that complied with California's 'assault weapon' registration demands.

It now appears that Sacramento is prepared to authorize the Department of Justice to send agents to the doors of those who lawfully registered these items to check for 'safe storage' and make sure that the inventory of registered 'destructive devices' matches what the CA-DOJ has on file.

The bill had begun life intended to allow searches of private citizens' homes as described above, but is now masquerading as a bill that simply allows agents to check the inventories of Hollywood special effects departments to make sure that their modified automatic weapons are being 'properly stored'.

This is the current amended text of AB 2580.

Is there any Freeper who's got legal eyes that can examine this particular section of the bill and tell us the meaning of these itemized passages?:

   (f) Except as provided in subdivision (g), the Department of
Justice shall, for every person, firm, or corporation to whom a
permit is issued pursuant to this article, annually conduct an
inspection for security and safe storage purposes, and to reconcile
the inventory of destructive devices.
   (g) A person, firm, or corporation with an inventory of fewer than
five devices that require any Department of Justice permit shall be
subject to an inspection for security and safe storage purposes, and
to reconcile inventory, once every five years, or more frequently if
determined by the department.
   (h) Subdivisions (f) and (g) shall not apply to individuals
possessing an assault weapon pursuant to a permit issued by the
Department of Justice for non-commercial purposes.  
The way I read it, this bill does not apply to private citizens -- though it sure started out that way. I believe that the last sections of AB 2580 were an amendment of the original bill. I don't pretend to be a lawyer, but for Freepers who are, please educate us on where the bill stands.

I have no idea by what means they plan to seach anyone, if it's a scheduled appointment or a warrantless 'no-knock' raid.

It doesn't apply NOW.BUT.....the oldest Political trick in the book is....

To pass an amendment to a Must Pass Bill (like a budget) that reads... to Amend AB2580 (or whatever they designate the actual Law, when passed..) by striking "Not" from subsection H.

These would NOT be the type of people to execute a "a warrantless 'no-knock' raid" on... unless they are trying to cut back the number of LEO in Calif.

What are these warrantless 'no-knock' raids? I've never heard of them! Do we have them here? Is it legal? Does it result in a lot of dead cops like it should?

There are "no-Knock" raids that ARE accompanied by a Warrant. but the warrant isn't shown until the site and occupants are secured. (You've seen it a million times if you ever watch TV - the old "bust the door down and go rushing in...)

These are issued if/when the judge is convinced that law enforcement would be placed at significant risk should they be forced to announce their presence prior to entering the building.

some would argue that these - even though accompanied by a warrant - are unconstitutional. The Patriot Act - puts some additional spins on things - I'll let you read it on your own and form your own opinion - rather than trying to force my on you. Freegards

One analysis of this bill:

Requires the DOJ to conduct annual inspections for every person, firm, or corporation with a dangerous weapons (short-barreled shotguns, short-barreled rifles, machine guns, assault weapons, other destructive devices) permit.

Requires the DOJ to conduct inspections once every five years, or more frequently within their discretion, for any person, firm, or corporation with an inventory of fewer than five devices

Apparently, there are about 300 permits that would be covered by this bill in inspections. It's just another way for government to increase regulations on law-abiding gun owners.

Your reasoning sounds like something to watch for... but can we confirm that the bill doesn't affect individuals right at the moment, should it pass?

These no-knock raids happen in Denver all the time. It doesn't matter if there is a warrant or not if they get the wrong address. Police shot a man to death named Mena a few years back because he heard his door being smashed and came down the stairs with a sidearm in his hand. Oops, wrong address.

Just my humble opinion, but I think Kalifornians need to treat these gross violator of the Constitution like coyotes: shoot em', shovel em', and shut up.

If this is allowed to go unchecked, the end really is in sight.

This would probably be extended to private individuasls during a 'tack on' to another Bill. That way there would be no big public notice and it might even slide thru unnoticed.
