Dear Mr. VanKirk:

I am in receipt of your letter dated May 28, 2002 concerning State Project X241-125-0.00 02, New River Parkway, Raleigh and Summers County.

I must say that this letter is of grave concern to me in that along with the letter is an enclosed map, "SANDSTONE FALLS ADDITION", that denotes my property as Tract 106-18 and as such calls for the acquisition of an area 35 feet by 25 feet (875 square feet) of my property.

This is of grave concern due to the fact that I have a letter dated March 14, 2000 from the Most Honorable U.S. Senator Robert C. Byrd that contained and enclosed letter from your department that reads as follows:

Dear Ms. Davis:

I have received the enclosed report from officials of the West Virginia Division of Highways (WVDOH) regarding your concern about the acquisition of your property in connection with the proposed New River project. I note that your property should not be affected by the revised acquisition alternatives.

You may be assured that I am pleased to have contacted WVDOH officials in your behalf and to make this update available to you. I hope that you find this information encouraging.

As I will not re-type the entire letter from your department to that of the office of the most Honorable Senator, I will re-type the sentence of which he refers:

"Ms. Davis' property should not be affected by our revised acquisition alternatives." (I shall be including these documents with this letter for your inspection).

These documents should reflect to you my concern, especially due to the fact that this is the first time any such map showed any portion of acquisition of my property at all save the ill conceived "Preferred Alternative" introduced September 9, 1999, that was of course rejected due to public outcry!

I thoroughly can not understand the need for this encroachment on my private property over the May, 1998 DEIS (Draft Environmental Impact Statement) and the associated maps that were a part of that study and design! Assuredly, this is the first time this "map" has ever been presented to me and my family!

I suggest this is once again an ill conceived endeavor to appropriate an estimated 80% of the value of my property by obtaining my well and septic systems of which you once again sorely fail!

"Purpose and Need" was presented to the residents of New River Road and the community of Hinton to benefit all the residents thereof and not to take anymore than needed for the construction and maintenance of such, as well to provide safe and easier access to all the resources of the surrounding areas.

This new communication from you only rests to assure me that the true idea of "Purpose and Need" is the exact opposite! That it is the sole purpose to displace and disenfranchise the residents of New River Road and eventually the residents of Hinton itself!

Therefore, I am forwarding this letter to the Most Honorable Senator Byrd, the Governor of this Great State, the Most Honorable President of these United States , as well as many others!

This proves that the agenda is take all the land one way or the other! I have never seen these maps until May 7, 2002!

But I bet those maps had been available for review at the local planning office...in the nearest galaxy...in a basement...in a locked filing cabinet... marked "Warning, Leper."

Good job. Time to get conciliatory by relieving Mr. VanKirk of the pain and expense of overt acquiescence.

No Dear Friend, no such map was ever made available to me or mine!!!!!!! This is an out and out deception.....in my opinion, and I can see not how it is! This is my land we are talking about after all and this is the first time I have ever seen such a map!!!!!!!!!!!

Thank you, but realize also, that this mess may well soon be your own! I love the ground I walk upon and I dare any federal agency or NGO to prove me wrong as to the best stewardship of this land!

I think a nice note from Senator Byrd to Mr. VanKirk, copied to Gale Norton, might be a more effective start. Certainly you should map out the chain of command and find the appropriate sympathetic link. Perhaps Mr. VanKirk would prefer to map the movement of sloughs in the Okeefinokee!

OOPS! I didn't realize Mr. VanKirk was a State of Virginia employee. Is this a Federal or State highway working with State Parks?

Ah, perhaps! I do like your wisdom! And I love your book! Opps, not supposed to say that am I?? Well, I can't help it!

I do doubt that VanKirk knows who Gayle Norton is, but she Should know who he is! But again I doubt it! I am fast learning that the "field has no clue and thus there is no team"!
