Actually, they can....thereafter the Supreme Court can declare it unconstitutional, thus moot.
It happens too frequently. Seems our Congressmen and Congresswomen have no concept of what might be Constitutional.

Actually it is worse than than. We citizens have to find a case with enough legs to make it to the SCOTUS, often times risking the freedom of the sacrificial goat.

Sadly, our judical and executive branch seem to be just as clueless as congress to the limitations of their powers.
