SPOKANE -- Charges against a woman accused in the death of her severely battered 4-year-old nephew have been raised to homicide by abuse, the equivalent of first-degree murder.
Shirley Lynne Anderson, 38, of Spokane, was arrested Wednesday on suspicion of first-degree manslaughter in the death of Alexander Wallace. The charge was elevated Friday because investigators found evidence that the boy had been abused, through assaults or lack of medical care, for a period of months. Homicide by abuse carries a standard-range minimum penalty of 20 years in prison.
Deputy Prosecutor Dawn Cortez also filed an alternative charge of second-degree felony murder, a lesser charge that would require the state to prove only that Anderson committed a second-degree assault that caused her nephew's death.
Anderson remained in the Spokane County Jail on $250,000 cash bond. Another bail hearing was scheduled Monday in District Court. The case, which remains under investigation, is scheduled for transfer to Superior Court within two weeks.
It was the second time in a week that a Spokane child died of injuries that authorities contend were inflicted by a caregiver. Two-year-old Serenity Rudd died May 22. Kenneth C. Bryan, 19, who had been watching her, has been charged with second-degree murder.
An autopsy on Alexander Wallace showed the boy died of internal bleeding caused by blows to both sides of his head. Court documents say the child had "dramatic head swelling," bruises all over his head and body, cuts inside his lip and on his genitals, a lacerated liver, a bruised small intestine, and internal bleeding.
Witnesses saw the child's injuries last weekend and on Monday, and some urged Anderson and her domestic partner, Luani Lehman, 40, to take the boy to a doctor. But the women failed to seek medical attention for that injury or any of at least three previous serious injuries since September, Detective Minde Connelly said in court documents.
Cortez said Anderson told investigators she didn't check on the boy Tuesday, though he had been in bed all day and hadn't eaten, because she "had company over and had overexerted."
When she called 911 the next morning, the child was dead.
Anderson and Lehman had joint custody of Alexander and his 5-year-old brother, Nathaniel Wallace. The older boy was not injured and was taken into state custody Wednesday.
The brothers moved in with the women before Superior Court Commissioner David M. Thorn gave them temporary custody on Feb. 7. Thorn, who was unavailable for comment, granted a default judgment after the boys' parents failed to respond to the custody lawsuit.
The boys' biological parents have had little contact with them, police say, and were barred by court order from seeing them at the women's home.
The women received food stamps, medical coupons and $440 a month to care for the boys, according to court documents.
Court records indicate Thorn did not seek a recommendation from state Child Protective Services, or appoint a guardian ad litem to represent the children.
A background check would have revealed that Anderson has five misdemeanor convictions, including one for misdemeanor assault that was pleaded down from second-degree felony assault.
It would also have revealed that Anderson and her daughter, Laura, now 19, had a history with Child Protective Services.
Laura Anderson pleaded guilty last year to first-degree robbery, second-degree kidnapping and second-degree assault and was sentenced to up to three years in prison. She admitted that she lured a man into a trap in June 2000, when she was 17, and helped two male co-defendants batter, rob, strip and sexually abuse the victim.
In court documents, psychologist Marty Beyer said Laura Anderson's "extraordinary story" of physical and sexual abuse by her mother and other relatives had contributed to her role in the crime.

Mother Accused Of Sexually Abusing Her Child
Child Protective Services and Universal City police are investigating allegations of child sexual abuse by the child's mother and her female partner.
According to a Child Protective Services worker statement, the alleged victim, who is now six years old and is underweight and developmentally delayed, said that on numerous occasions she would be given a shot and then was sexually assaulted. The girl is now staying with an aunt in Corpus Christi.
Leslie Morris, the child's mother, denied the accusations in an interview with KSAT 12 News. "I've had that happen to me as a child, and I would never, ever, think of putting my child through that," Morris said. "Her showing signs where she's been hurt or whatever, my aunt's put that in her head. I'm mad that this is all happening to me. I feel like the victim."
Morris' female partner, Norma Smith, who is also the subject of the investigation, is in jail on an unrelated domestic abuse charge. Universal City police have filed two counts of indecency with a child charges against Morris and Smith.
Sgt. Bill Gabbard said that he is ready to arrest the women if the Bexar County District Attorney's office accepts the case decides to press second-degree felony charges. "It's always disturbing when these children have to go through this," Gabbard said. "And who do they cry to, especially when mom's involved?"
But to be honest anyone can be a bad parents/guardian. Hetero, Homo, reb, brown or white. But to say any race, or 'persuation' is better than all the rest (as Miss Rosie did) is just wrong.
Take my word for it, these foster-lesbo's were into some serious 'fisting' activity. These kinds of injuries are not easy to administer . . .
