Man shoots, kills intruder while second suspect flees

03/28/02

A West End man shot and killed a man invading his home Thursday night, police said.

Officers came to a shooting at a duplex in the 1900 block of Francis Avenue about 7 p.m. They found the homeowner with a bleeding head wound and another man hit with a shotgun blast. That man later died at Baptist Medical Center Princeton.

The dead man's name was unavailable Thursday night.

The homeowner and witnesses told police that two armed men pulled up to the house and charged inside, said Sgt. Daniel Carr. One struck the homeowner with a shovel or similar implement, Carr said. The homeowner opened fire with his shotgun and the second man fled.

Police later caught a man they believe was involved in the incident, Carr said.

Police investigators had marked at least six shell casings in the street in front of the duplex.

The homeowner sat on a curb, a gauze pad on his head and blood streaming down his face. He was taken to Baptist Medical Center Princeton. He was in satisfactory condition Thursday night.

I guess I'll be the first to say it; Don't bring a shovel to a gun fight.

Not that a shovel certainly wouldn't come in handy later...

"Police investigators had marked at least six shell casings in the street in front of the duplex."

this is the part that do not sounds good shell casings in the street, you can defend yourself inside your house, chasing someone on the sidewalk etc,it`s a bad idea.
hopefully the da will clear the homeowner.

If someone is attacking you with a deadly weapon (shovel etc) YOU HAVE THE RIGHT TO DEFEND YOURSELF WHEREEVER YOU ARE.

Hopefully the DA will take into account that the man was hit in the head with a shovel and might have been a bit dazed and confused.

you can defend yourself,in the house or street, but the shells in the street sounds like he went out of his house chasing second suspect and continue shooting, that is not legal, even if it sounds okay.

What do you mean? The homeowner obviously swept the shells off from his porch onto the street. Or maybe the wind blew them into the street? :)

very good point. If it's ever a choice between my life or taking a chance with the law, I know which one I'd choose.

It's not legal? Maybe not in Kalifornia buddy. In many places it would not be seen as a problem. Nobody is going to go after someone for something like this. (unless you are in KA, NY, or New England, or some inner city)

Here's a good example of what I just said. This was posted just before this article.

Pickup's owner kills suspected burglar

By S.K. BARDWELL

Evidence in the fatal shooting of a burglary suspect by a northeast Houston man early today will be referred to a grand jury without charges, police said.

Juan Fernando Flores, 30, of the 300 block of Vincent, died from a gunshot wound to the head after a homeowner in the 200 block of Kelley opened fire on two men he caught taking tools from his pickup truck about 1 a.m., police said.

The two men fled in a car after the shooting, but police said the car crashed and began to burn a few blocks away in the 5400 block of Fulton.

A passerby pulled Flores from the driver's seat of the burning car, and told police a second man in the car fled on foot. Flores, who suffered at least one gunshot wound to the head, was dead. Police were unsure whether his passenger was wounded.

In the car Flores had been driving, police said they found a variety of tools, some of which were identified as belonging to the resident in the 200 block of Kelley

I'm afraid you've been brainwashed by Kalifornia "justice".

Well that account explains why shells were found outside and why the victim was hit with a shovel. Sounds justifiably to me. Tools are damn expensive. I'll bet dollars to donuts the perps aren't even legal residents. Hope they catch the other one and I hope the victim doesn't live with too much anguish.

This is a opinion you wouldn't want to base your bank account, your job,and your freedom on,but that is exactly what you would be doing. Seriously.
