Vear Bill signed by Gov. Engler.
Submitted on: March 26, 2002
The Vear Transportation Bill was signed this morning. It is now PA 82 of 2002.
MCRGO wishes to thank the Governor, our friends in the legislature and the NRA as well all of our members who made the calls, wrote the letters, and kept the push on for this new law.

I would also like to thank my reps, Valde Garcia and Judie Scranton for once again, doing the right thing. I also thank Chris Dingell for leading the charge on this bill in the Senate, and Steve Vear for leading the way in the house.
I jumped the gun before on this. It turned out Engler was on vacation, and that was the reason for the delay. He called Chris Dingell awhile back and said he signed it, but it wasn't signed then. Well it is now.
This law now makes it legal to carry a pistol in a auto without a trunk without a CCW. Before I had to be either hunting or on my way to a shooting range of which I am a member. DNR range was ILLEGAL. Taking it to the POLICE station was illegal(registration). NOT ANYMORE!
It's finally cleared up. This is a big win for our side. It took 2 years and a veto, but we finally did it.
Now we have some more work to do. Senator Raczkowski sounds nice. Governor Posthumus sounds nice. Congressman Shugars, Barcia, Dingell, and Rogers sounds much better than Congressman Upton, Kildee, Rivers, and Hollister(Or whoever Rogers will face).
And let's keep Robert Young in the Supreme Court!!!!!!
US Congress and State House - 2 years
State Senate, Governor, Att General, Sec of State - 4 years
US Senate - 6 years(unfortunatly)
Judges - I have no idea
Local offices (Sheriff, prosecutor, township boards, clerk, county commish etc) - Not sure.
Thanks to you DFM, and the folks at MCRGO. Nice job!
As I read the law, without a CCW, everyone who took their pistols anywhere without a valid hunting license during hunting season was committing a felony.
Correction - as I read the law before the Vear bill passed, it was a felony to go practice with my pistol if I didn't have a trunk. Vear now makes it legal to practice.
Both of your statements were correct. With a trunk, it was legal to take your unloaded, cased, and locked pistol ONLY to a club range (if you were a member), to a hunt, or to a gunsmith or shop. Without a trunk, it was illegal to do even that.
This bill was mostly gutted before Governor Engler would sign it. It's an improvement over the old law insofar as trunkless vehicles are now OK, and the membership requirement for shooting-range-as-destination was dropped. It's still illegal to stop for gas or a hamburger with an unloaded, cased, locked pistol in one's vehicle.
(The law making possession of a pistol illegal is not applicable...)
(d) To a person while transporting a pistol for a lawful purpose that is licensed by the owner or occupant of the motor vehicle in compliance with section 2 of 1927 PA 372, MCL 28.422, and the pistol is unloaded in a closed case designed for the storage of firearms in the trunk of the vehicle.
(e) To a person while transporting a pistol for a lawful purpose that is licensed by the owner or occupant of the motor vehicle in compliance with section 2 of 1927 PA 372, MCL 28.422, and the pistol is unloaded in a closed case designed for the storage of firearms in a vehicle that does not have a trunk and is not readily accessible to the occupants of the vehicle.
(b) Lawful purpose includes the following:
(i) While en route to or from a hunting or target shooting area.
(ii) While transporting a pistol en route to or from his or her home or place of business and place of repair.
(iii) While moving goods from 1 place of abode or business to another place of abode or business.
(iv) While transporting a licensed pistol en route to or from a law enforcement agency for the purpose of having a safety inspection performed on the pistol as is required by section 9 of 1927 PA 372, MCL 28.429, or for the purpose of having a law enforcement official take possession of the weapon.
(v) While en route to or from his or her abode or place of business and a gun show or places of purchase or sale.
(vi) While en route to or from his or her abode to a public shooting facility or public land where discharge of firearms is permitted by law, rule, regulation, or local ordinance.
(vii) While en route to or from his or her abode to a private property location where the pistol is to be used as is permitted by law, rule, regulation, or local ordinance.
A dangerous bill is about to reach Gov. John Englers desk. HB 5026 would seriously weaken Michigans law against carrying guns in cars and trucks without a concealed weapon permit (CCW). Gov. Engler vetoed a similar measure last year, but now the gun lobby is at it again. HB 5026 would let almost anyone carry a gun in a car or truck whenever they feel like it, even if they dont have the police permit. People with guns in their vehicles wont even have to tell the police that they have a gun if they get pulled over! HB 5026 is a threat to police officers and to public safety. Please contact Gov. Engler and your state legislators and tell them that Michigan does not need more guns in cars and trucks. Please act today!
Vear was like a juggernaut. There was nothing for them to gain by voting against it. I do find the breathless fearmongering Brady/MMM/CPHV/AGS (they're all the same) prose amusing however. Not to mention their usual lies about the real details of the law...`
