I'll be interested to read the actual opinion. This appears to be very good news, but it's clear that the ranchers didn't win on every claim.

I didn't think they would, because they were essentially wanting the court to treat the grazing lease as an actual conveyance of ownership, which it isn't.

But it does set out the principle, apparently, that the government can't unilaterally yank rights granted under the lease, specifically water rights, even though the lease arguably gave them the power to do so.

This sounds like a decision which takes away a great deal of power from the federal government, and that is a great thing.

This is good news. I'm not one for touting rediculous sums for court decisions but in this case i hope the government pays HUGE sums so that it becomes too expensive to steal private property. In addition, I hope the court finds anyone joining the government in this case to PAY JUST AS MUCH.

As we know, early American common law descended from English common law. What did the English think of private property?

This appears to be a ruling for the people, and it is good news, unless it's overturned by a higher court or ignored by the bureaucrats who started the conflict.

This article insinuates that Federal takings of this nature have been going on long before 1991. I find this disturbing since RR is one of my favorite ideologues.
