nope. 2nd degree felony... xanax is schedule IV controlled substance in chapter 893 (see post #306)... to wit...

FSS 893.03 Standards and schedules...
(4) SCHEDULE IV.--A substance in Schedule IV has a low potential for abuse relative to the substances in Schedule III and has a currently accepted medical use in treatment in the United States, and abuse of the substance may lead to limited physical or psychological dependence relative to the substances in Schedule III. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances, including its salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation, are controlled in Schedule IV:

(a) Alprazolam

FSS 893.149 Unlawful possession of listed chemical.-- (1) It is unlawful for any person to knowingly or intentionally: (a) Possess a listed chemical with the intent to unlawfully manufacture a controlled substance; (b) Possess or distribute a listed chemical knowing, or having reasonable cause to believe, that the listed chemical will be used to unlawfully manufacture a controlled substance. (2) Any person who violates this section is guilty of a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

She was charged under this law. It is a third degree felony.

FSS 893.13(7a9) PRESCRIPTION FRAUD - It is unlawful to acquire or obtain or attempt to acquire or obtain possession of a controlled substance by misrepresentation, fraud, forgery, subterfuge, or deception (3rd Deg. Fel).

Prescription Forgery Felony, Up to $5000 Fine & / or Up to 5 Yrs in Pen.
