Let me get this straight...
They arrive at the guys home, NO SEARCH WARRANT...disturb the peace...ORDER HIM INTO ARREST POSITION...and tell him TO SIGN A CONSENT (With SEVERAL GUNS POINTED AT HIS HEAD)...Or else he will have to WAIT OUTSIDE IN THE COLD...no suitable clothing...while they GET A WARRANT?!
1) If he wasn't under arrest, why did he have to leave his residence? By forcing him to leave, they coerced an agreement. Harrassment, conspiracy, false arrest/detainment...Violation #1.
No warrant, and yet GUNS ARE DRAWN?!?! Arrault with intent charges to be filed...Violation # 2.
They confiscated items...WITHOUT CONSENT OR WARRANT...Theft of personal property... Violation # 3.
Had tehy TRIED to confiscate his .50 Cal, I'd say he had a case in court against them for penalizing him in an ex post facto manner. Could be claimed as a Bill of Attainder against ALL law-abiding owners...this tack SHOULD be used against the "Assault Weapons Banned" weapons.

Thanks, I just rang them up. The guy anwering the phone was polite enough (which I was in return), but you could tell he was an ass-kisser. Either that or his Nazi boss was standing there giving him dirty looks, who knows. Comments like "well that was just someones opinion in the article", stuff like that.
He didn't respond when I asked him if the facts of the article (not having a warrant and no evidence of a crime being commited) were correct.
When he heard where the conversation was going he sounded as if he was writing from that point on. I pointed out how events like these cause negative backlash against LEOs and depletes resources (i.e. if the guy sues) but all I was getting was "uh huh" and "duh ...yeah". That's when I realized I wasn't getting anywhere by talking to a bonehead.
I suggest that anyone who lives in the area to do whatever they can to get this POS unelected on the next go around. Send a message. Flyers are cheap to copy and local talk radio is easy to get through to in small towns.

Thanks for the post. At least the poor bastard came out alive--BATF has a VERY shoddy reputation for not being too concerned about killing victims of its 'raids.' Does sound to me, too, as if a large lawsuit could be interesting.

This couldn't have happened...
Lots of freepers said that Bush would put a stop to this kind of stuff...Oh - I forgot - He's busy fighting terrorism. They say that 60 countries are "harboring" terrorists (59 more to go). I wonder if the US is on the list, and if so, who are the terrorists? Could it be this guy? Could it be us?
